Judge James A. Manley dealt with the following cases Wednesday, May 11:

Sean Dean Ogle, 50, homeless, had his 20-year suspended sentence revoked and he was sentenced to the Department of Corrections for 15 years with 10 suspended. Because Ogle’s revoked sentence, at time of original sentencing, was under a “good time” statute, he is still eligible. So his five years could be completed in 2.5 years, but it can also be taken away for violating conditions while serving jail time.

Ronald Bernard Cadena, 33, Polson, for criminal possession of dangerous drugs, a felony, was sentenced to the DOC for three years, none suspended, and screened for an appropriate treatment program. He was credited for days served. 

Michelle J. Nault, 29, Polson, had her felony sentence for criminal possession of dangerous drugs deferred for three years and she was credited for 30 days successfully served in a treatment program.

“I do appreciate how hard you are working at this,” Judge Manley said, adding that the sentence reflects substantial effort made by Nault at rehabilitating herself.

Rueben Daniel Cutfinger, 51, Pablo, had his felony sentence for criminal possession of dangerous drugs deferred for two years. Cutfinger is required to enter and enroll in tribal re-entry program. Judge Manley said the sentence gives Cutfinger a chance “not to be homeless and unemployed for another 20 years.” 

Jule Rose Brueggeman, 27, Ronan, pleaded not guilty to felony burglary and felony theft. An omnibus hearing is set for Sept. 7 and a jury trial is set to start Oct. 17.

According to court documents, on Sept. 16, 2015, a woman came home to her Pablo residence and found the back door open and several items of personal property missing. The value of the items was in excess of $1,500. She noticed people removing her property from a truck at a duplex near her home, but when she approached, they drove off. The woman followed them to a storage shed, where Brueggeman, the registered owner of the truck, was allegedly unloading the property. Additional items belonging to the woman were found in Brueggeman’s truck.

James J. McGuire, 33, St. Ignatius, pleaded not guilty to two felony counts of assault with a weapon and criminal mischief, a felony.

An omnibus hearing is set for Sept. 7 and a jury trial is set to start Oct. 17.

According to court documents, on April 3 McGuire entered his wife’s home, with whom he is separated, and found her in bed with her paramour. McGuire allegedly operated the slide on his .45 semi-automatic pistol and threatened the two both verbally and with the weapon. McGuire denied aiming the gun at them, but allegedly admitted in an interview that “nothing gets someone’s attention like the sound of a racking gun,” and he wanted to put the fear of God into the male. McGuire left the residence but not before allegedly shooting a hole through the male’s unoccupied car.

Sherry Leigh Kohfeld, 27, Elmo, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for Sept. 7 and a jury trial is set to start Oct. 17.

According to court documents, on Oct. 18, 2015, three baggies of meth were discovered in the vehicle Kohfeld was driving. 

Stein Erick Anderson, 32, Polson, in a change of plea admitted that on Jan 31, 2016, he was in control of a vehicle in Lake County under the influence of alcohol, with a person under the age of 16 in the vehicle.

The court found him guilty of an amended charge of driving under the influence of alcohol and drugs, first offense, a misdemeanor. Sentencing was one year in Lake County Jail with all suspended but 48 hours and credited for time served. He can be considered for a probationary license and was released from 24/7 supervision.

Terry Harold Foss, 49, Bigfork, in a change of plea admitted that on Jan. 17 he was operating a motor vehicle on a public roadway in Lake County while under the influence of alcohol and did not immediately heed the officer who attempted to stop Foss. Foss was found guilty of DUI, a misdemeanor, and guilty of fleeing or eluding a peace officer. A criminal endangerment charge was dismissed per the plea agreement. Foss was sentenced to six months in Lake County Jail on each count, all suspended except 24 hours, to be served concurrently. He is to be considered for a probationary license.

Eldon Gene Runsthrough, 29, Polson, admitted that on March 26 he entered a Polson home and took a television, then pawned it at a local pawnshop. Then in a change of plea, admitted that on June 23, 2015, Runsthrough stole items from Walmart and when police arrived, they found him in possession of a stolen van.

The court found Runsthrough guilty of burglary, a felony; theft, a felony; and theft, a misdemeanor. Sentencing is set for July 13. Runsthrough was released on his own recognizance. 

Ronald Melvin Parnell, 32, Ronan, in a change of plea admitted that on Oct. 22, 2015, he possessed methamphetamine. He also admitted to an amended charge of criminal endangerment, a felony.

According to court documents, on Oct. 22, 2015, Parnell’s probation officer found him smoking meth from a pipe when she arrived at his home to conduct a probation search. Officers also discovered photos on his phone of females under the age of 16 engaging in sexual contact.
