A Polson woman, formerly of Hot Springs, had her imposition of sentencing deferred for three years. The action stems from charges of aggravated assault and drug possession.

Evelyn Josephine Franks, 27, entered into a plea agreement at District Court in Polson on April 9. One count of criminal possession of drugs was dismissed with a joint recommendation for deferred sentence on the other two charges.

Franks admitted to assaulting a woman in Elmo on July 7, 2018. Charging documents show Franks was at a residence in Elmo when, for an unknown reason, she attacked another woman by biting her in the eye after hitting her.

The victim told investigators that she “thought her eye was going to pop out.” She was treated at Providence St. Joseph Medical Center in Polson. The treating physician told the woman that her eye required consultation for microscopic repair.

During a sentencing hearing in District Court in Polson on June 4, Judge Deborah “Kim” Christopher gave Franks credit for 17 days jail time already served and ordered her to pay restitution of $3,618.92.
