A Kalispell man is accused of a fourth driving while under the influence charge after being slumped over behind the wheel of his car at 5:30 a.m.

Trey Chandler Grilley, 27, entered a plea of not guilty at District Court in Polson on Feb. 25 to what court records show would be his fourth DUI.

According to court records, on Dec. 13, 2020, a Lake County Sheriff’s Office deputy responded to the report of a vehicle parked in the middle of Rocky Point Road, north of Polson. The deputy arrived to find the vehicle still running, the lights were on and the driver, later identified as Grilley, was slumped over to the side and unconscious.

A preliminary breath test showed Grilley’s blood alcohol content at over the legal limit. A more accurate test, taken during the booking process at the Lake County jail, showed Grilley’s blood alcohol content was at .097. Records show Grilley has three prior convictions for DUI.

Judge Deborah “Kim” Christopher set the case for trial on July 26. Grilley is at liberty on his own recognizance.
