Lake County District Court news for Nov. 11, 2010

Judge C. B. McNeil heard the following cases on Nov. 3:

Robert Stokes, 27, Ronan, had his suspended sentence for bail jumping, a felony, revoked and was sentenced to the Department of Corrections for one year. Stokes violated his parole by failing to report to his parole officer and failing to get a job. He also admitted using marijuana and prescription medications for which he did not have a prescription.  The Court also recommended Stokes be considered for placement in boot camp. Upon successful completion of boot camp, the remainder of Stokes’ sentence will be suspended.

Robert Joseph Conley, 60, Trout Creek, was found guilty of criminal endangerment, a felony, and was sentenced to the DOC or three years with all suspended except thirty days in Lake County Jail. For driving while license suspended or revoked, Conley was found guilty and sentenced to six months in LCJ with all suspended but two days. 

According to court records, the charges stem from an April 6 incident when a Tribal Officer stopped Conley after observing him make several U-turns on US Hwy 93, cross the center and fog lines and then almost turn into a ditch. 

Conley admitted to the officer that he’d had seven mixed drinks before driving and told the officer that he did not have a driver’s license or insurance in the car. 

When a Lake County Sheriff’s Deputy took over, he noted that Conley had unsteady balance, smelled of an alcoholic beverage and had slurred speech and glassy eyes.

Kimberly L. Joseph, 39, Elmo, was found guilty of driving while under the influence of alcohol or drugs, fourth or subsequent offense, a felony and committed to the DOC for 13 months. In addition Joseph was sentenced to the DOC for five years with all suspended.

Court documents state that Joseph was waived over by Montana Highway Patrol Trooper Jim Sanderson while he was dealing with a traffic stop at the intersection of Haack Road and Hwy. 93. Joseph was drinking from a Bacardi rum container, which she surrendered to Sanderson. As he finished the traffic stop, Joseph pulled another Bacardi drink from the back seat of her vehicle. 

Joseph refused to perform field sobriety tests. Her records indicated she had four previous DUI convictions. 

Jason R. Eversole, 41, Bigfork, had his suspended sentence for criminal possession of dangerous drugs, second or subsequent offense, a felony, revoked. 

Sentencing was set for Nov. 24.

Lonnie William Muth, had his sentence for criminal endangerment revoked and was sentenced to the DOC for three years. The Court recommended Muth for screening and placement in Connections Corrections, a drug and alcohol treatment center.

According to court document, Muth violated his parole by drinking alcohol and being sentenced to charges of resisting arrest and partner/family member assault, second offense, on Oct. 8.

Jessica Lozeau, 25, Ronan, had her sentence for theft, a felony, revoked. Court records indicate on Jan. 28, a Lake County Sheriff’s Deputy spoke with an individual about a theft from her house on June 21. The person claimed a glass jar full of paper money in the amount more than $1,000 was discovered missing after Lozeau had visited the home.

Lozeau initially denied taking any money, but later admitted to taking a hand full of cash from the jar in the amount of $23, then changed the amount to $236, and finally rested at $293. Lozeau also admitted to taking the jar the money was stored in and throwing it over a bridge on the Fourth of July Pass in Idaho.

In a separate case, Jessica Lozeau pleaded guilty to criminal possession of dangerous drugs, a felony.

Sentencing was set for Dec. 18.

 

Judge Deborah Kim Christopher dealt with the following cases on Nov. 4:

Tiffany Edwards, 23, Ronan, was sentenced to LCJ for six months with all suspended for forgery, a common scheme, a felony. The Court also ordered Edwards to serve 14 days in LCJ with credit for time served. 

As part of Edwards’ plea bargain, sentencing was deferred for three years on a charge of deceptive practices, a felony. According to court records, the forgery charge stems from a time period of June through November 2009, where a total of 30 checks had been written without the owner’s permission on two different accounts. The owner was the mother of Edward’s boyfriend.

David Langan, 28, Milford, New Jersey, was sentenced for burglary, a felony, and theft, a misdemeanor. Pursuant to Langan’s plea agreement, he was sentenced to the DOC for 10 years for the burglary charge with all suspended. For the theft charge, Langan was sentenced to 90 days in LCJ. According to court documents, Langan is liable for restitution in the amount of $10,819.73.

The charges stem from two April 2009 incidents when firearms and silverware valued at more than $1,000 were missing from a home on Skidoo Lane. The homeowners located their firearms at the Jolly Pack Rat six days later, and also found their stolen silverware at Gold Rush Pawn in Kalispell. 

Another cabin on Skidoo Lane was also broken into at a later date and a variety of items were stolen and pawned.

Dacia Tonasket, 31, Elmo, pleaded not guilty to assault with a weapon, a felony. 

An omnibus hearing was set for Dec. 9 and a jury trial for Feb. 7, 2011.
