Lake County District Court news for Sept. 17, 2014

District Judge Deborah Kim Christopher dealt with the following cases Thursday, Sept. 11:

Douglas Kenmille, 24, Elmo, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing was set for Nov. 21 with a jury trial commencing on Jan. 23, 2014.

According to court documents, police officers arrested Kenmille through a warrant issued though Tribal Court on Jan. 25, 2012. During a routine search when Kenmille was arrested, an officer found two methamphetamine pipes and a plastic bag containing a white crystalline substance. The state crime lab in Missoula identified residue on one of the pipes as methamphetamine.  

Christy Lyne Urban, 27, Polson, was not present so Ashley Morigeau, Urban’s attorney, asked for the case to be moved to the end of the calendar. According to court documents, James Lapotka, the state’s attorney, objected, noting three new cases had just been filed against Urban and requested a warrant for $50,000. 

The Court signed an arrest warrant, and the matter continued at 10:30 a.m. in Judge Christopher’s chambers after Urban arrived and was arrested.

According to court documents, charges stem from a Jan. 5, 2013, incident in which Urban was stopped driving a vehicle. During the search, the officer located a suspected used methamphetamine pipe wrapped in a towel behind the driver’s seat.

An omnibus hearing was set for Sept. 18. 

Michael Trombley, 27, Pablo, pleaded not guilty to driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony, or the lesser charge of operating a noncommercial vehicle by person with alcohol concentration of .08 or more, a felony.

An omnibus hearing was set for Oct. 16 with a jury trial commencing on Dec. 8 

According to court documents, the charges stem from May 23 when Trombley drove a vehicle on Montana highways open to the public while under the influence of alcohol or drugs.

Elizabeth Matt, 17, Charlo, had her deferred sentence for two counts of criminal possession of dangerous drugs, a felony, revoked. The Court sentenced Matt to five years in the Department of Corrections with none suspended. Matt is to be screened by the DOC for the most appropriate treatment facility, followed by pre-release. Matt will receive credit for time served while incarcerated. 

According to court documents, charges stem from a March 25, 2013, incident when an officer patrolling Lake County observed a vehicle that had been reported stolen. When the officer arrested the driver and Matt, the passenger, he found a bottle with two Ativan pills in it in Matt’s pocket. When asked about other contraband, Matt retrieved a methamphetamine pipe and gave it to the officer.
