Lake County District Court news for Jan. 28, 2015

Judge James A. Manley dealt with the following cases Wednesday, Jan. 21:

Paul A. Matteucci, 50, Kalispell, was sentenced to the Department of Corrections for eight years for felony theft, all suspended to run consecutively to three Flathead County cases. Matteucci was also ordered to pay fines, including $2,500 in restitution. 

According to court documents, charges stem from a November 2013 incident where the managers of a restaurant in Woods Bay reported that Matteucci had stolen about $2,430 by taking money from bank bags and gambling pots.

Karen Valerie Tromp, 61, Arlee, was sentenced to DOC for five years, all suspended, for criminal possession of dangerous drugs, a felony. 

According to court documents, on July 5, 2014, Tromp consented to a search of her purse at the Arlee Powwow Grounds. A small bag of methamphetamine and a small glass pipe with residue was found in her purse. 

Matthew Day, 38, Polson, pleaded not guilty to criminal distribution of dangerous drugs, a felony; and criminal possession of dangerous drugs, a felony. An omnibus hearing is set for Feb. 25 and a jury trial is set for   April 6.

According to court documents, charges stem from an October 2013 incident where a Lake County Sheriff’s deputy entered a building with a search warrant. Several baggies of methamphetamine, marijuana, a baggie of cocaine and a baggie with multiple prescription pills — plus pipes, scales, grinders, syringes, and pill bottles — were found in Day’s bedroom. 

He admitted selling drugs, but not in large quantities; he said he only sells to support his own habit, according to court documents.

Christopher James Irvine, 40, Pablo, pleaded not guilty to criminal possession of dangerous drugs, felony.

An omnibus hearing was set for Feb. 25 and a jury trial was set for April 6. However, Irvine’s attorney said there is a plea agreement in process for the current charge and his sentencing on revocation from a previous charge; the change of plea and sentencing is set for Jan. 28.

According to court documents, the current possession of dangerous drugs charge stems from a July 2011 incident where Irvine was found to be in possession of methamphetamine during a traffic stop. Irvine is currently on probation, and has tested positive for methamphetamine numerous times, most recently December 2014. 

Daniel T. Beavers, 46, Polson, in a change of plea admitted to driving while under the influence of alcohol or drugs, fourth or subsequent offense, a felony. The court found Beavers guilty and sentencing was set for Feb. 25.

According to court documents, charges stem from an October 2014 incident where a police officer stopped the vehicle Beavers was driving. Beavers told the officer he had been drinking, and a breath sample showed he had .162 blood alcohol concentration. His driving record showed three prior DUI convictions.

Robert Matt, 26, St. Ignatius, admitted violating conditions of probation and parole and had his deferred sentence for fraudulently obtaining dangerous drugs revoked. The court found Matt guilty and sentenced him to DOC for five years, where he will enter and complete Connections Correction and boot camp, if screened and approved by DOC.

According to court documents, Matt violated probation by testing positive for opiates in June 2014 and positive for methamphetamine in September 2014.

 

Judge Deborah Kim Christopher dealt with the following cases Thursday, Jan. 22:

Raymond James Burland, 39, Pablo, was sentenced to DOC for five years for driving under the influence of alcohol or drugs, a felony. He was recommended for a treatment program and pre-release.

According to court documents, Burland’s suspended sentence for the same conviction was revoked Nov. 20, 2014, and he was also caught consuming alcohol Jan. 11, with a breath test reading .215.

Roger Cruz, 51, Missoula, for felony burglary was sentenced to DOC for five years with all suspended except for one day that he already served.

According to court documents, charges stem from a February 2013 incident where Cruz allegedly entered a restricted area of a manufacturing plant in Ronan after his employment was terminated and cut several phone and computer lines. On Dec. 4, 2014, Cruz changed his plea to “no contest,” and the court found him guilty.

Joetta S. King, 30, Missoula, was sentenced to 30 days in Lake County Jail for criminal possession of dangerous drugs. The remainder of her sentence was deferred for three years. If she completes a 30-day impatient chemical treatment program, the jail time will be waived.

According to court documents, charges stem from a July 2014 incident where King had her purse searched upon entering the Arlee Powwow Grounds, and methamphetamine was found inside.

Marcus Azure, 25, Ronan, pleaded not guilty to criminal possession of dangerous drugs, a felony.

An omnibus hearing is set for Feb. 19 and a jury trial is set to begin April 13.

According to court documents, charges stem from a September 2013 incident where Azure was searched while being arrested on an unrelated matter. Azure had a plastic tube with several methadone pills inside, which he said he purchased after winning a jackpot.

Kathrine Price, 42, St. Regis, admitted violating conditions of probation and parole. The court found her guilty and revoked her suspended sentence for felony DUI, fourth offense. She was sentenced to DOC for five years.
