Judge James A. Manley dealt with the following cases Wednesday, April 22:
Sonny Morigeau, 38, Ronan, was sentenced to 30 days in Lake County Jail and credited for time served provided he gets an updated chemical dependency evaluation within 60 days. The remainder of his sentence for felony criminal possession of dangerous drugs was deferred for three years.
According to court documents, Morigeau was arrested on unrelated charges in November 2013. Tribal officers found several small baggies that contained the presence of methamphetamine.
Matthew Day, 38, Polson, had his sentence for felony criminal possession of dangerous drugs deferred for three years provided he gets an updated chemical dependency evaluation within 60 days. Two other charges were dismissed.
Tyler Frederick Erickson, 21, Polson, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for June 17; a jury trial is set to begin Aug 3.
According to court documents, on March 23 Erickson’s probation officer searched his bedroom and, along with a Mission Mountain Task Force agent, they found nine small baggies with methamphetamine residue, a plastic container containing meth, and other drug paraphernalia.
Justice Raven Nicolai, 19, Charlo, pleaded not guilty to felony theft. An omnibus hearing is set for July 15; a jury trial is set to begin Sept. 1.
According to court documents, on March 3 a Lake County Sheriff’s Deputy got a report of a stolen motorcycle, and was able to review surveillance footage that showed a Dodge Nitro — with cardboard covering a broken back window — drive into the yard. The footage showed a male suspect push the small Yamaha minicycle out the gate. The vehicle was later found at a Charlo residence where Nicolai lives. The physical description of Nicolai matched that of the man who stole the motorcycle.
Four days later the deputy saw the suspect vehicle on Highway 93 in Arlee. The vehicle had expired plates, and Nicolai was driving although he did not have a driver’s license. Nicolai allegedly confessed to stealing the motorcycle at that time. The owner had a receipt for the motorcycle that showed its value in excess of $1,500, making the theft a felony.
Jeffery Allen Hogan, 63, Polson, in a change of plea admitted committing an amended offense of disorderly conduct, a misdemeanor. The court found Hogan guilty. He was sentenced to Lake County Jail for 10 days with credit for time served, and ordered to pay a $100 fine and $85 in court costs.
According to court documents, a woman called 911 on Dec. 3, 2014 to report that Hogan had assaulted her on Nov. 28, 2014. She had been cooking a large dinner in both her kitchen and Hogan’s, who lived in the same apartment complex. When she went to his apartment to get a pot of chili and a roasting pan out of the refrigerator, he pushed her to the floor, causing her to slip under the table and cut her thumb.
Beth A. Oldhorn, 30, Spokane, for violating conditions of parole and probation, had her previously suspended sentence for felony criminal possession of dangerous drugs with intent to distribute revoked and she was sentenced to Montana Women’s Prison for six years with none suspended.
According to court documents, in August 2010 the vehicle Oldhorn was riding in was stopped on Highway 93 near Ronan. Two packages of methamphetamine were found in the vehicle. Both Oldhorn and the driver stated the meth was Oldhorn’s and she intended to sell it. Oldhorn later admitted committing the offense in a plea agreement, and in June 2012 she was sentenced to the Department of Corrections for eight years with six suspended.
Judge Deborah Kim Christopher dealt with the following cases Thursday, April 23:
Levi Ted Clatterbuck, 33, Ronan, was sentenced to the Department of Corrections for 13 months, to be placed in a treatment program, plus four years all suspended, for driving under the influence of drugs or alcohol, fourth or subsequent offense, a felony.
According to court documents, in October 2014 Clatterbuck was stopped on Highway 35 for driving 81 mph in a 50 mph zone. The Polson Police officer noted signs of intoxication, but Clatterbuck refused to give a breath sample. He later changed his not guilty plea to guilty in a plea agreement.
Christine Diane Wingender, 57, Ronan, pleaded not guilty to criminal possession of dangerous drugs and criminal possession of dangerous drugs with intent to distribute, both felonies. An omnibus hearing is set for July 9; a jury trial is set to begin Aug. 24.
