Father, son facing charges

POLSON – A father and son are facing charges for separate incidents in Lake County.

Richard Shawn Twoteeth Jr. faces a rape charge stemming from September 2015, while Richard Sr. faces his fourth DUI charge from June 2015.

Twoteeth Jr., 20, of Pablo, allegedly had sexual intercourse with an extremely intoxicated woman who was physically helpless.

The state has three witnesses, including two women and a man, the latter who said he witnessed the alleged crime through the window of a home, according to a court document.

The alleged victim said she remembered only drinking some “40s” with her sister and then waking up the next morning.

An arrest warrant was issued Dec. 16, 2016, and Twoteeth Jr. was arrested May 7. He pleaded not guilty on May 18 and was allowed to be released on his own recognizance but was required to pay for a GPS-monitoring device. He was also ordered to have no contact with the alleged victim or witnesses. As of Tuesday, June 6, he was still in jail, presumably because he couldn’t afford to pay for the GPS. A trial date has been scheduled for Sept. 11.

Twoteeth Jr. was also charged with aggravated assault and tampering with evidence related to an Oct. 19, 2015 incident in which he allegedly entered a home, hit a man in the face while he was sleeping, kicked him in the mouth and broke his eye socket. Twoteeth Jr. then allegedly left the house, disposed of his boots, returned to the home and was arrested. The alleged victim, who was treated at a hospital, was unable to be located later by the county attorney’s office, prosecuting attorney Ben Anciaux said. The charges were dismissed without prejudice on March 14, 2016, which means they could be refiled.

Twoteeth Sr., 47, of Polson, was arrested on June 16, 2015 for allegedly knocking over a turn signal pole at the intersection of Light Road and U.S. 93. According to a court document, Twoteeth Sr. could not recite the alphabet correctly.

He was released on June 17, 2015 but failed to show for a court hearing. A warrant was issued on July 23, 2015, and he was arrested again on May 26, some 22 months later. He spent five days in jail and was released on his own recognizance on May 31 after pleading not guilty. Judge James A. Manley scheduled his jury trial for Nov. 6.
