District Court
Judge C. B. McNeil addressed the following cases on Sept. 16:
• Donny Ray George, 28, of St. Ignatius appeared for sentencing on revocation of his suspended sentence.
George was previously convicted of two counts of sexual intercourse without consent on Sept. 22, 1999. He finished eight years of prison time on Jan. 20, 2007, and began serving the remainder of his 10-year sentence on count one, with two years suspended, on probation. When that period expired on Jan. 19, 2009, he began to serve a 10-year suspended sentence on probation for count two.
According to court records, George violated conditions of his probation by: failing to report to his probation officer on numerous occasions in 2008 and 2009; was charged with an open container violation on June 7, 2007; was in possession of alcohol on at least three occasions in 2007 and 2008; missed sex offender treatment meetings in 2008 and 2009; and associated with someone on probation.
The judge revoked George's 10-year suspended sentence and committed him to 10 years in prison with five years suspended, with his time to be served in the Missoula Pre-Release Center, as recommended by his probation officer.
• Angela Lee Morrow, 43, of Ronan, changed her plea to guilty to the felony of driving under the influence of alcohol or drugs, fourth or subsequent offense, operating a vehicle with a blood alcohol content of .08% or greater, fourth or subsequent offense, a felony, to driving while license is suspended or revoked, second offense, a misdemeanor and to failure to provide required insurance, a misdemeanor.
She was found guilty and dismissed the charge of operating a vehicle with a BAC of .08% or greater, and was committed to the DOC for 13 months with a three-year commitment to DOC with all suspended on the charge of driving under the influence. She was sentenced to six months in jail with all suspended on the charge of driving while license is suspended, and to six months with all suspended on the charge of failure to provide required insurance.
According to court records, on April 17 at approximately 7:30 p.m., Morrow was observed leaving Arnie's Gas and Tire in Ronan and appeared to be having difficultly walking to her vehicle. A Tribal Police Officer followed and observed her drive over the curb while turning onto U.S. Highway 93. Morrow then turned onto Main Street SE, and she began driving on the wrong side of the road, at which time the tribal officer stopped her.
A Ronan Police Officer was called to respond to the scene and detected the odor of an alcoholic beverage coming from Morrow's breath. Also there were 16- and 20-ounce beer cans in the passenger seat. A breath test registered a BAC of .179. At the Lake County Jail, Morrow continued to fail a number of sobriety tests. A records check indicated her license was suspended and she was previously convicted of driving while license is suspended, revoked or cancelled in a municipal court in Wyoming. Morrow's court driving history also shows that she has had at least three prior convictions for driving under the influence of alcohol or drugs.
•Keith B. Cowen, 18, of Blaine, Wash., pleaded guilty to felony possession of explosives. The court found Cowen guilty and according to a plea agreement, the charge of criminal mischief, a misdemeanor, was dismissed. He received a deferred sentence for a period of three years consisting of serving 30 days in jail with credit for time served, and fined $435.
According to court records, there were several calls made to Lake County Dispatch on Aug. 27 regarding explosions along Terrace Lake Road, east of Ronan. A witness followed an SUV with no doors and got a license plate number of the vehicle. Law enforcement officers later located the vehicle at a Ronan home and conducted interviews with the occupants, including Cowen, who admitted to lighting sparkler bombs and placing them in mailboxes.
A Lake County Sheriff's Deputy confirmed that two mailboxes were destroyed by explosives, which were strong enough to send debris more than 150 feet from the blast site.
• Matthew Julian Michel, 21 of St. Ignatius, changed his plea to guilty of the felony of burglary, and to the amended offense of theft, a misdemeanor. He was found guilty and received an imposition of sentence to be deferred for three years for burglary which consists of 20 days in jail, full restitution, and fined $310. On the charge of theft, he was sentenced to jail for six months with all suspended except seven days.
According to court records, on June 6 a Lake County Sheriff's Deputy responded to a report of burglary at the Albert Custom Cabinets shop in Pablo. The owner of the shop told the deputy that things looked out of order that morning, and realized that someone had broken in the night before.
A window on the south side of the building was ajar, with tire tracks on the grass outside near the window. Several tools, two computers, some DVD's, two guitars and some money were claimed to be missing by the shop owner.
On June 8, an employee of the Jolly Pack Rat called the Sheriff's office and said someone had tried to sell the tools matching the description of the tools stolen from the shop. The employee convinced the person to leave the tools and come back in a little while.
Meanwhile, deputies responded to the Jolly Pack Rat, examined the tools and after waiting for several minutes, gave up and left the pawn shop. They then observed a man matching the description of the suspect enter the pawn shop. After speaking with the man, identified as Michel, he admitted to breaking into the cabinet shop and taking the tools.
• Jessica Lynn Lozeau, 24, of Ronan changed her plea to guilty to committing the offense of theft and Lozeau was found guilty. According to the plea agreement, the felony charge of tampering with or fabricating physical evidence will be dismissed. Sentencing is set for Wednesday, Oct. 21 at 9 a.m.
According to court records, on Jan. 28, a Lake County Sheriff's Deputy spoke with an individual about a theft from her house on June 21. The person claimed a glass jar consisting of bills in the amount more than $1,000 was discovered missing after Lozeau had visited the home.
Lozeau initially denied taking any money, but later admitted to taking a hand full of cash from the jar in the amount of $23, then changed the amount to $236, and finally rested at $293. Lozeau also admitted to taking the jar the money was stored in and had thrown it over a bridge on the Fourth of July Pass in Idaho.
Judge Deborah K. Christopher heard the following case on Sept. 10, 2009:
• Leroy James Hayes, 44, of Polson pleaded not guilty to the charge of driving under the influence of alcohol or drugs, a felony, to proof of compliance, and to driving while license is suspended or revoked, misdemeanors. The case will be set for trial at a later date. A change of plea hearing was set for Thursday, Sept. 24 at 9 a.m.
According to court records, the charges stemmed from an incident on Aug. 4 when Hayes was stopped for erratic driving and failure to signal a turn. Signs of alcohol intoxication were observed and he performed poorly in sobriety testing. Breath test resulted in .211 BAC. Hayes was then put under arrest and taken to jail for further processing. A check of driving records indicated that driving privileges were suspended at the time Hayes was driving, and he had three prior convictions of DUI.
Justice Court
Justice of the Peace Chuck Wall addressed the following cases from Sept. 11 to Sept. 17:
• Daniel Clayton Coughren, 22, pleaded guilty to negligent endangerment - substantial risk, death/serious bodily injury, a misdemeanor, was found guilty, fined $100 and charged $85 in court costs.
• Douglas Roy White, 52, pleaded guilty to failure to carry proof of insurance - second offense, was found guilty, fined $350, charged $35 in court costs, and sentenced to 10 days in jail with eight days suspended. If White provides proof of six months continued coverage, jail time will be waived.
Polson City Court
Judge A. Douglas Olson dealt with the following cases from Sept. 5 to Sept. 11:
• Deserae Lee Bays, 25, pleaded not guilty to driving while privilege to do so is suspended or revoked, and to operating without liability insurance in effect - first offense. She was found guilty on the first charge, was fined $250 days in jail with 98 days suspended, and was charged $35 in court fees. On the second charge, she received a deferred sentence, was fined $100 and charged $35 in court costs.
• Davida Cecilia Medina, 23, pleaded not guilty to driving without a valid drivers license - expired less than 180 days, to endangering welfare of a child - first violation, and to reckless driving. She was found guilty on all three charges, was fined $100 and charged $35 in court costs on the first offense, and fined $200, charged $85 in court costs and sentenced to 10 days in jail with all 10 days suspended on the second offense. On the third offense, she was fined $300 and charged $35 in court costs.
• Brittney Marie Wersonick, 23, pleaded not guilty to disorderly conduct and to assault, a misdemeanor. She was found guilty of the first offense, fined $100 and charged $85 in court costs. She received a deferred sentence for the second offense, was fined $100, charged $85 in court costs and sentenced to 10 days in jail with all 10 days suspended.
• Virginia Ruiz Butler, 56, forfeited her bond of $50 for a speeding violation, going 48 mph in a 35 mph zone.
Ronan City Court
Judge Doug A. Olson dealt with the following cases from Aug. 29 to Sept. 10.
• Ryan James Schnabl, 24, pleaded not guilty to reckless driving, was found guilty, was fined $350, charged $35 in court costs and was sentenced to 10 days in jail with 10 days suspended.
• Kathleen Cheff, 44, received a deferred sentence for operating with an expired registration - failure to reregister, was fined $50 and charged $35 in court costs.
• Jeremy Palmer, 33, forfeited his bond of $20 for speeding, going 35 mph in a 25 mph zone.
• Dennis Dirks, 51, received a deferred sentence for operating with an expired registration - failure to reregister, was fined $50 and was charged $35 in court costs.
St. Ignatius City Court
Judge Sharon Richardson addressed the following cases from Aug. 1 to Aug. 31:
• Shawn Wippert, 36, pleaded guilty to driving while privilege to do so is suspended or revoked. He was found guilty, fined $400, charged $35 in court fees, and sentenced to 180 days in jail with 178 days suspended.
• Thomas Ladenburg, 46, pleaded guilty to driving under the influence of alcohol - first offense, he was found guilty, fined $600, charged $85 in court costs and sentenced to 180 days in jail with 178 days suspended.
• Jennah Slegfried, 19, forfeited her bond of $75 for speeding, going 60 mph in a 45 mph zone.
• Chelsea Rabideau, 20, forfeited her bond of $50 for speeding, going 55 mph in a 45 mph zone.
• Ivy Foster, 33, forfeited her bond of $75 for speeding, going 60 mph in a 45 mph zone.
