District Court

Judge Deborah K. Christopher heard the following case on Oct. 1, 2009:
• Marty Robert Evans, 26, of Missoula was sentenced to the prison for 50 years with 20 years suspended for the offense of attempted sexual assault. Evans is designated as a Level III offender and is not eligible for parole until completion of chemical dependency, anger management and sexual offender treatment programs. In May a jury found Evans guilty of sexual intercourse without consent and not guilty of sexual assault.
According to court records, on Dec. 10, 2008 a Polson Police Officer was called to a residence where a woman in the home said she found Evans lying in bed next to her six-year-old daughter. She said Evans had been staying at the home since Thanksgiving.
The mother told officers that Evans had previously sexually assaulted one of her cousins and had been warned about leaving her daughter alone with Evans.
The officers found Evans pretending to be asleep in the home, took him to the Lake County Jail and was then interviewed by a Polson Police Detective.
Evans told the officer that he "didn't know what he was doing" and "he woke up sleeping on (the child's) bed." He told the officer that he usually slept in her bed when she goes to school. He also stated that he had been very intoxicated and that his memory was bad.
According to a Lake County affidavit, there was also a petition filed to revoke the release on bond because Evans violated two conditions of his release, specifically failure to remain at his brother's residence and consumption of alcohol.
• Daniel Francis Bisson, 57, of Ronan, pleaded guilty to felony driving under the influence of alcohol or drugs, was found guilty and sentencing is set for Thursday, Dec. 3 at 9 a.m.
According to court records, on June 2, a Lake County Deputy was patrolling Back Road near Polson when he noticed a blue Nissan Sentra driving over the center line of the road several times.
After being stopped, the deputy noticed a strong odor of an alcoholic beverage and that Bisson's eyes appeared glassy. Bisson said he had a few drinks and the passenger in the car said they were returning from a party.
The poor performance of several sobriety tests by Bisson indicated to the deputy that he was under the influence of alcohol and was placed under arrest. A bag of marijuana was found in Bisson's pocket.
During booking at the jail, a breath test yielded a .174% BAC and a records check indicated that Bisson had six prior convictions for DUI.
• Johnathan Morton, 20 of Polson, changed his plea to guilty of felony burglary. He was found guilty and sentencing is set for Thursday, Nov. 12 at 9 a.m.
According to court records, on Nov. 13, 2008 a Lake County Sheriff's Deputy responded to a burglar alarm at Wilson Family Foods in Arlee. A Tribal Officer was at the store and noted that the back door was open and an 18-pack of beer was in the alley behind the store.
Both the officer and deputy noticed that the break-in was from an addition that was under construction, entering from the ceiling into the office. According to in interview by a deputy with Cote Wheeler, Wheeler stated that a group broke in from the ceiling of the addition and took three cases of beer. After the alarm was set off, Wheeler said they panicked and exited through the back door. One case of beer was dropped, but two other cases were taken.
• Johnathan Morton, 20, changed his plea to guilty of a felony burglary. He was found guilty and sentencing is set for Thursday, Nov. 12 at 9 a.m.
According to court records, the charges stemmed from an incident occurring on Nov. 19, 2008 at Pigasis Bar in Arlee where Lake County Sheriff's Deputies were dispatched for a burglary reported from the owners of the bar. The owners stated that sometime during the previous night, someone entered the bar through a window and once inside, took several bottles of liquor worth approximately $800, two knives and $500 in cash.
Later that evening, a person told the deputy they noticed a suspicious driver in a green Dodge pickup in the area on the evening of the burglary. On Nov. 22, an anonymous tip indicated Cote Wheeler was the person who burglarized the Pigasus. A registration check indicated Cote is the owner of a green 2002 Dodge pickup. Records indicate Wheeler admitted in a Jan. 16 interview that he and a group of people burglarized the Pigasus Bar. Wheeler stated that Colton Wheeler had previously worked at the bar and knew where the cash was kept.
Wheeler explained to officers that he and Morton entered the building while others kept watch and took the knives, 32 bottles of alcohol and cash.
• Johnathan Morton, 20, changed his plea to guilty of a felony burglary, was found guilty and sentencing is set for Thursday, Nov. 12 at 9 a.m.
According to court records, on Dec. 13, the owner of a home on West Post Creek Road called Lake County Dispatch about a burglary. The homeowners said they left their home approximately 10 a.m. and returned at 4:30 p.m. to find that someone had entered their house through the garage.
They were missing three guns, including a Remington 1100 shotgun, a camera, jewelry and cash. Tire tracks were found in the driveway, with fingerprints on an owner's manual from inside the home. The shotgun was later located in a Kalispell pawn shop.
The tread from the tracks were similar to the ones on Cote Wheeler's vehicle, who was identified as a suspect. During an interview with Wheeler on Jan. 16, he admitted to breaking into the residence with Johnathan Morton.
• Brady Todd Ruff, 27, of Belgrade, changed his plea to guilty of felony driving under the influence of alcohol or drugs, was found guilty and sentencing is set for Thursday, Dec. 3 at 9 a.m.
According to court records, on July 14 a call to 911 dispatchers reported a possible drunk driver in a grey Ford pickup was driving all over the road and tailgating south on U.S. Highway 93. A license plate was provided by the caller.
Another call was made from a person reporting a dark grey and silver truck that was swerving all over the road and also tailgating. Just minutes later, a Sheriff's Deputy passed the grey Ford near Lake's Corner.
The truck was observed crossing the fog line, and almost hit the 35 mph speed limit sign entering Ronan. Ruff was pulled over and said that he did not have his drivers license with him, and later admitted to lying about the spelling of his name to the deputy.
While speaking with Ruff, the deputy noticed that he slurred his speech, smelled of alcohol and seemed to have difficulty understanding what was going on. When stepping out of the vehicle, he had difficulty keeping his balance.
Ruff refused to take a breath test, and failed a number of field sobriety tests and was taken to the jail for further processing.
A records check indicated that Ruff had three prior convictions of DUI and his license was suspended.
• Matthew J. Sides, 19, of Blaine, Wash., pleaded not guilty to felony possession of explosives and misdemeanor criminal mischief. An omnibus hearing is set for Thursday, Nov. 5 at 9 a.m.
According to court records, several calls made to Lake County Dispatch on Aug. 27 indicated explosions taking place along Terrace Lake Road, east of Ronan. A witness followed an SUV with no doors and got a license plate number of the vehicle. Law enforcement officers later located the vehicle at a Ronan home and conducted interviews with the occupants, including Sides, who admitted to lighting sparkler bombs and placing them in mailboxes.
A Lake County Sheriff's Deputy confirmed that two mailboxes were destroyed by explosives, which were strong enough to send debris more than 150 feet from the blast site.
• Harlan Gerald Vaska, 45, of Missoula, pleaded not guilty to felony driving under the influence of alcohol or drugs. An omnibus hearing is set for Thursday, Nov. 19 at 9 a.m.
According to court records, on Sept. 4, at 3 a.m., a Montana Highway Patrol Trooper was called to a one-vehicle crash on Post Creek Hill Road. The trooper noticed yaw marks leading from the southbound lane, across the northbound lane and into a field on the east side of the road.
The trooper noticed that Vaska's eyes were glassy and bloodshot, his speech was very slurred and there was a strong odor of alcoholic beverage coming from his breath. Vaska also was unsteady on his feet and had to lean against the patrol car for balance while being arrested.
During booking at the jail, Vaska performed poorly on a number of sobriety tests and at 5 a.m., his breath test resulted in a BAC of .147%.
The trooper asked Vaska if he thought that at the time of the crash he'd been impaired from the alcohol he'd had to drink that night, and Vaska stated "Yeah, I probably was."
According to court records, Vaska has seven prior convictions of DUI in Montana, including one felony from 2003 and a felony conviction for driving with a BAC over .08% in the state of California in 1999.
• David Anthony Martinez, 40, of Polson was sentenced to the Department of Corrections for five years with four suspended for partner/family member assault and to 10 years with eight years suspended for the felony assault with a weapon. The sentences will run consecutively.
According to court records, on July 7 an intoxicated Martinez assaulted a partner/family member in Polson by striking her in the head with a propane bottle four times, resulting in the assault with a weapon charge.
On July 30 in Polson he was arrested for partner/family member assault for, according to court records, striking a woman. He was also intoxicated, a violation of the conditions of his release on the assault charge.
• Dale L. Burkhart, Jr., 53, of Charlo, received a deferred sentence of imposition for three years for felony criminal distribution of dangerous drugs. Burkhart was sentenced to 20 days in jail or on house arrest.
The charge stems from a June 9 incident in which a Lake County Sheriff's deputy pulled over a speeding vehicle near Arlee. During a search of the vehicle, two bags of marijuana were found and the occupants said they'd just purchase the marijuana from Burkhart.
Then Burkhart later admitted to the deputy that he sold one of the occupants the marijuana but claimed to have a medical marijuana card and to be a register marijuana provider. However he also admitted that he knew he was not supposed to sell marijuana to that individual because he did not have a medical marijuana card.
• William Thomas Fritsch, 54, of Polson was sentenced to the Montana State Prison for five years with no time suspended for felony failure to register.
According to court records, on Feb. 9 Fritsch was involved in a complaint made by his nephew’s girlfriend. She notified the Lake County Sheriff’s Office that she had left her boyfriend’s residence earlier that evening to go to the store. She had left her two-year-old daughter at the residence. When she returned, she observed Fritsch standing in front of her daughter inappropriately.
According to Fritsch’s criminal history and records with the Montana Department of Adult Probation and Parole, Fritsch was convicted of sexual assault on May 18, 1992. Fritsch told the Polson police detective that he had not registered in Lake County because he had not been living in the county for more than three days.
However, an investigation into Fritsch’s work history showed he had been employed in Polson for approximately one year. By law, Fritsch is required to register as a sexual offender with the Lake County Sheriff within 10 days of entering Lake County.

Judge C. B. McNeil dealt with the following cases on Sept. 30:
• Jesse Joe Big Beaver, 27, of Arlee had her sentence for felony burglary revoked and was sentenced to the DOC for 10 years with eight years suspended. Big Beaver violated her probation by changing her place of residency without obtaining permission from her Parole Officer, and by failure to notify the officer of change of employment.
• Wesley Jean Couture, 51, of Billings, pleaded not guilty to felony driving under the influence of alcohol or drugs, fourth or subsequent offense. An omnibus hearing is set for Wednesday, Oct. 21 at 9 a.m.
According to court records, on Sept. 6 at 2:13 a.m. a Flathead Tribal Officer observed a Ford traveling on Old Highway 93 in the area of Joe Dog Drive in Pablo. The vehicle was drifting from left to right, driving in the middle of the road, and made a left turn without signaling.
The driver pulled into a trailer court and walked towards a house. The officer parked with his lights off. A short time later, the officer observed Couture get back into the Ford and drive northbound on Old Highway 93.
Couture was observed driving across the center line with both tires for approximately 20 feet. Once stopped by the officer, he noticed that Couture's eyes were red and glossy and a strong odor of an alcoholic beverage came from his breath.
According to court records, Couture admitted to having a revoked drivers license and to drinking a six-pack of beer earlier. A field sobriety test indicated that Couture scored four out of six possible clues of impairment. He also could not recite the alphabet. The officer then called for a Montana Highway Trooper to take over the investigation.
A records check indicated that Couture had nine prior DUI convictions and was currently on parole in Billings. The trooper also noticed a strong odor of an alcoholic beverage, glossy eyes and that Couture spoke with a slow, slurred manner of speech.
Couture would not cooperate with the trooper's attempts to conduct sobriety tests, and once taken to the Flathead Tribal Detention Facility at 2:55 a.m., still refused a breath sample or to participate in sobriety maneuvers.
• Dennis Dean Smith, 49, of St. Regis, pleaded guilty to felony driving under the influence of alcohol or drugs, fourth or subsequent offense. Smith was found guilty and sentencing is set for Nov. 4 at 9 a.m.
According to court records, the charges stem from an incident on June 20 when a Polson Police officer was called to Main Street for a report of a man drinking in a pickup and throwing cans onto the street. The officer observed Smith open a 12-pack of beer sitting on the passenger floorboard of the truck while the truck was running.
When Smith saw the officer, he turned off the truck and when stepping out, used the door for support and his balance appeared to be impaired, the officer reported.
After conducting three sobriety tests, the results indicated to the officer that Smith was impaired.
During processing at the jail, Smith refused to perform any field sobriety maneuvers or answer any questions without an attorney. Court records indicated that Smith had four prior DUI convictions and that he was on felony probation out of Mineral County.
• Brandon Dean Bockus, 30, of Ronan, pleaded not guilty to misdemeanor driving under the influence of alcohol, third offense, felony criminal endangerment, misdemeanor driving while license is suspended or revoked, and to misdemeanor failure to provide required insurance, third offense.
An omnibus hearing will be Nov. 4 at 9 a.m.
According to court records, on April 6 at 1:26 a.m., following a report of a vehicle possibly driven by someone under the influence of alcohol, a Flathead Tribal Officer located a southbound vehicle on U.S. Highway 93, near Post Creek Hill going southbound. Bockus' then swerved into the officer's northbound lane, approximately 100 yards from his vehicle. The officer had to slam on his brakes in order to avoid impact and the officer steered onto the shoulder of the road. The vehicle then approached within 20 feet of the patrol, swerved into the northbound lane, just missing the patrol car by approximate four feet, according to the officer's report.
The officer turned around and pulled the vehicle over. The officer noted a strong odor of an alcoholic beverage coming from the driver's breath, identified as Bockus.
Tribal Dispatch indicated that Bockus had three prior DUI convictions and his license was revoked out of Great Falls. He was not an enrolled tribal member, so a Lake County Sheriff's Deputy was then called to investigate the incident.
According to court records, the deputy noticed Bockus' speech was slurred and slow and he also had difficulty with his balance while walking to the deputy's patrol car.
The court records indicate Bockus admitted to having two beers, but after being asked again after some field sobriety tests, he admitted to having three 12-ounce beers while driving. Bockus performed poorly on three additional sobriety tests and refused a breath test.
• Desiree Mocalee Peone, 25 of St. Ignatius pleaded guilty to two charges of misdemeanor assault, was found guilty and was sentenced to six months in jail with all suspended but 15 days on the first offense of assault. On the second offense of assault, Peone was sentenced to six months in jail with all suspended but 15 days. The sentences are to run concurrently.
According to court records, on June 20 a Tribal Dispatcher reported Peone was leaving the Four-Star Bar and she was reported to be very intoxicated and was driving a red Ford Focus, with a child in the vehicle.
A records check indicated her license was reported to be suspended. A Tribal Officer observed Peone crossing the fog line several times going up Ravalli Hill and he then initiated a traffic stop. A Sheriff's Deputy also responded to the scene.
Peone refused to step out of the vehicle, as the officer noticed a small child in the back seat. Upon the second request, she complied, but refused to perform any sobriety tests and became upset.
According to court records, the officer noticed a strong odor of an alcoholic beverage coming from her breath and her speech was slow and slurred. Upon cuffing Peone, she became uncooperative and spit on the officer.
En route to the tribal jail, she managed to slip one hand out of the handcuffs, and when the officer pulled over and opened up the back seat door, she began kicking at the officer in the arm and chest.
During processing at the tribal jail, she again made several attempts to kick and scratch officers, causing one to bleed through a rubber glove.
• Thomas James Evans, 22, of Ronan was sentenced to 40 years in the Montana State Prison with 20 years suspended. He was found guilty of sexual intercourse without consent. He is not eligible for parole until he completes the in-patient sex offender program, Evans is designated as a Level II sex offender.
According to court records, on May 13, 2007, a Lake County Sheriff's Detective was contacted by Flathead Tribal Police Officers about a sexual assault complaint involving a 14-year-old girl who was picked up near the hospital by Evans to meet up with other friends at a Ronan residence on Round Butte Road.
The two drove near the Ronan residence, but along the way Evans pulled off onto a dirt road and demanded oral sex. After she refused, Evans forced the girl to do so. She later told her sister and a friend about the incident after arriving at the Ronan home.
A Lake County Sheriff Detective conducted an interview with the 14-year-old's sister who said she confronted her brother and he admitted he had requested that the girl perform a sexual act.
• Matthew Tyler Rardin, 25, of St. Ignatius, pleaded not guilty to four accounts of felony criminal possession of dangerous drugs, and to misdemeanor criminal possession of drug paraphernalia and to obstructing a peace officer. An omnibus hearing is set for Wednesday, Oct. 28. at 9 a.m.
According to court records, on Aug. 17, a Lake County Sheriff's Deputy and a Flathead Tribal Police Officer responded to a noise complaint in St. Ignatius at a residence. Following an arrest and sobriety check, a search of the residence produced a small wooden box containing a bag of marijuana, 14 tablets of methadone, and 8 tablets of clonazepam. Also, a digital scale and 22 tables diazepam were found. During booking, a breath sample of Radin produced a BAC of .080%.
• Joseph J. Sparks, 19, of Blain, Wash., pleaded not guilty to felony possession of explosives and misdemeanor criminal mischief. An omnibus hearing is set for Nov. 18 at 9 a.m.

Justice Court

Justice of the Peace Chuck Wall addressed the following cases from Sept. 5 to Oct. 1:
• Kaitlin P. Macker, 23, pleaded guilty to failure to carry proof of insurance - first offense, to driving without a valid drivers license - expired less than 180 days, and to speeding in a special/restricted zone, going 65 mph in a 50 mph zone, was found guilty on all three offenses, was fined $150 and charged $35 in court costs on the offense of failure to carry proof of insurance, was fined $250 and charged $35 in court costs and sentenced to 180 days in jail with 180 days suspended on the offense of driving without a valid drivers license. For speeding, she was fined $30 and charged $35 in court costs.
• Duane L. Reid, 18, pleaded guilty to disorderly conduct, was found guilty and was fined $100, charged $85 in court costs and was sentenced to 10 days in jail with seven days suspended.
Reid had three days credited time.

Polson City Court

Ronan City Court

Judge Doug A. Olson dealt with the following cases from Sept. 10 to Oct. 1.
• Brandon Knapp, 29, pleaded guilty of driving while privilege to do so is suspended or revoked, he was found guilty, fined $350, charged $35 in court costs and sentenced to 2 days in jail.
• Johnathan Polk, 36, received a deferred sentence for speeding, going 27 mph in a 15 mph zone, exceeding the restricted speed limit established by local authority. He was fined $30 and charged $35 in court costs.
• Jordan Christiansen, 19, pleaded guilty to driving without a valid drivers license - expired more than 180 days, to operating without liability insurance in effect - first offense and to reckless driving. She was found guilty on all three offenses, fined $135 for driving without a valid drivers license, fined $235 for operating without liability insurance and sentenced to two days in jail and on the reckless driving offense, she was fined $185 and sentenced to 10 days in jail.
• Edie Dawn Avendano, 38, pleaded guilty to driving without a valid drivers license - expired less than 180 days, to criminal possession of dangerous drugs and to operating without liability insurance in effect - first offense. He was found guilty on all three offenses, fined $185 for driving without a valid drivers license, fined $385 for criminal possession of dangerous drugs and fined $235 and sentenced to two days in jail for operating without liability insurance in effect.
• Brian P. Posivio, 37, pleaded guilty to disorderly conduct, was found guilty and was fined $100 and charged $85 in court costs.
• Paulson W. Palmer, 29, forfeited his bond of $20 for speeding, exceeding day limit of 65 mph.
• Ronald Allen Joslin, 48, received a deferred sentence for operating with an expired registration - failure to reregister and for speeding in a restricted speed zone, going 25 mph in a 15 mph zone and was fined $40.
• Jeanne K. Emerson, 45, received a deferred sentence for speeding, going 27 mph in a 15 mph zone, was fined $30 and was charged $35 in court costs.
• Charlene T. Matt, 73, received a deferred sentence for speeding, going 25 mph in a 15 mph zone, was fined $40 and charged $35 in court costs.
• Rachel N. Dupuy, 31, forfeited her bond of $40 for speeding, going 36 mph in a 25 mph zone.
• Ben Olsen, 29, forfeited his bond of $40 for speeding, going 40 mph in a 25 mph zone.

St. Ignatius City Court

Judge Sharon Richardson addressed the following cases from Sept. 1 to Sept. 30:
• Linda Herring, 60, forfeited her bond of $50 for speeding, going 55 mph in a 45 mph zone.
• Carol Sanders, 49, forfeited her bond of $50 for speeding, going 35 mph in a 25 mph zone.
• Edward Rosen, 65, forfeited his bond of $50 for speeding, going 55 mph in a 45 mph zone.
• Donald Ackerman, 54, forfeited his bond of $50 for speeding, going 55 mph in a 45 mph zone.
• Sharon L. Richardson, 72, forfeited her bond of $50 for speeding, going 35 mph in a 25 mph zone.
• Francis McGovern, 31, forfeited her bond of $50 for speeding, going 55 mph in a 45 mph zone.

• Jacob Albright, 26, pleaded guilty to a violation of the dog/cat ordinance, was fined $100 and sentenced to one day in jail with one day suspended. Albright was ordered to pay a vet bill and an emergency bill of the victim.
• Don Isador Mitchell, 25, forfeited his bond of $50 for failure to have a child under six years old and less than 60 pounds properly restrained, he was fined $50 and charged $35 in court costs.
• Cecily Whistler, 19, forfeited her bond of $50 for speeding, going 55 mph in a 45 mph zone.
• Michael Touchette, 39, forfeited his bond of $50 for speeding, going 55 mph in a 45 mph zone.
• Darren Schlepp, 39, forfeited his bond of $100 for speeding, going 67 mph in a 45 mph zone.
• Lucas Barbara, 41, forfeited her bond of $75 for speeding, going 65 mph in a 45 mph zone.
