District Court

Judge Deborah Kim Christopher dealt with the following cases June 24, 2010:
• Waleya Lynn Rossbach, 32, Arlee, was sentenced to five years at the Department of Corrections with three years suspended for felony criminal possession of drugs.
According to court records, the charge stems from an incident on June 13, 2009 when a Tribal Officer and a Lake County Sheriff’s Deputy responded to a disorderly conduct report at Wilson Family Foods in Arlee.
The reporting party informed the officers that a man and his girlfriend, Rossbach, came into the store and were shouting profanities.
The officers went to the home of the man, and he was slow to come to the door. Once he did, he only locked it, claiming to have locked the keys inside.
Once inside, the officers searched the bedroom and found three spoons with white powder on them wrapped tightly with plastic, a plastic baggie containing 1-2 grams of a white powder that was consistent in appearance and texture with the substance in the spoons. he powder later tested positive for opiates. The officers also found two syringes.
The man stated that his girlfriend, Rossbach also shared the room, and uses the syringes to prepare and inject methadone and that she injects the methadone into her hands.
The deputy spoke with Rossbach, who stated that none of the items seized from her bedroom belonged to her and requested her attorney.
The interview was terminated, but while speaking with Rossbach, the officer noticed fresh needle track marks on the top of her left hand, directly over a prominent vein. He also noticed she had a nearly identical scar on the top of her right hand.
• Marc A. Friscia, 21, Polson, admitted to felony tampering with or fabricating physical evidence. He was found guilty and sentencing is set for Aug. 5 at 9 a.m.
According to court records, the charge stems from a Jan. 10, 2009 incident when a Polson Police Officer responded to a reported parole violation at the residence where Friscia was living.
The violation was not in connection with Friscia, but while conducting a search of the home, the officer found two butane lighters and a glass pipe with residue consistent with that used to smoke dangerous drugs.
The officer asked to have Friscia contact him to discuss the pipe.
During this voluntary interview, Friscia admitted to holding the paraphernalia for a friend who was on felony probation. The friend feared his house would be searched and asked Friscia to go to his residence and clean out the top drawer of his dresser, where the paraphernalia was located.
Friscia’s description of the events and evidence matched observations made by officers in the friend’s probation search.

Judge C.B. McNeil dealt with the following case June 23, 2010:
• David Matthew Okland, 49, Polson, admitted to felony DUI - fourth or subsequent offense. He was found guilty and sentencing is scheduled for July 28 at 9 a.m.
According to court records, the charges stem from a Dec. 27, 2009 incident when a Polson Police officer observed a vehicle crossing the Polson bridge going 45 mph in a 35 mph zone. After the officer turned on his lights, the vehicle did not respond. Once the officer turned on his siren the vehicle pulled over after .61 of a mile.
As the officer spoke with the driver, identified as Okland, he could smell the odor of an alcoholic beverage, and observed that Okland’s eyes were bloodshot and glassy.
During field sobriety testing, the officer observed that Okland’s balance was impaired and when asked to perform the HGN test, he became combative and told the officer, “I can’t. I’m drunk.”
He was then arrested and taken to jail for further processing. During booking, Okland performed a series of sobriety maneuvers that indicated that he was under the influence of alcohol, but refused a breath test.
A check of Okland’s driving history showed that he has four prior DUI convictions.

Justice Court

Justice of the Peace Chuck Wall dealt with the following cases June 18-24:
• Jorge Medina, 29, pleaded guilty to careless driving, failure to carry proof of liability insurance, driving without a valid drivers license - expired less than 180 days, operating a vehicle that hasn’t been properly registered and a seatbelt violation. He was found guilty on all counts, fined $820, charged $140 in court costs and sentenced to 180 days in jail with 175 days suspended.
• Bryan Craig Buys pleaded not guilty to reckless driving. He was found guilty, fined $300, charged $35 in court costs and sentenced to 90 days in jail with all suspended.
• Thomas Neil Pelican, 53, pleaded not guilty to a violation of a protective order - first offense. He was found guilty, fined $300, charged $85 in court costs and sentenced to 74 days in jail with credit for 46 days already served.
• James Randall Hanson, 48, pleaded guilty to failure to follow conditions and requirements of a special permit. She was found guilty, fined $100 and charged $35 in court costs.
• Aaron Robert Acosta, 20, pleaded guilty to driving a motor vehicle while privilege to do so is suspended or revoked. He was found guilty, fined $200 and charged $35 in court costs.
• Earleen T. King, 60, pleaded guilty to selling or providing alcoholic beverages to a person under 21 years of age. She was found guilty, fined $150, charged $35 in court costs and sentenced to 180 days in jail with all suspended.
• Jeffrey Muller, 47, pleaded no contest to improper passing – passing in a no-passing zone. He was fined $50 and charged $35 in court costs.

Polson City Court

Judge A. Doug Olson dealt with the following case June 19-25:
• Benjamin Franklin Hoffman, 33, pleaded not guilty to resisting arrest and obstructing a police officer or other public servant.
He was found guilty, charged $170 in court costs and sentenced to 20 days in jail.
