Lake County District Court news for Nov. 5, 2014

Judge Deborah Kim Christopher dealt with the following cases on Oct. 30: 

Courtney Ann Cattaneo, 33, Butte, had a suspended sentence revoked. She was sentenced to three years in the Department of Corrections. She may be considered for conditional release. 

According to court documents Cattaneo broke the conditions of probation by using illegal drugs. She has previously been convicted of theft and issuing fraudulent checks in Idaho and Lake County. 

Mary Victoria Matt, 43, St. Ignatius, pleaded not guilty to felony criminal possession of dangerous drugs. 

According to court documents Matt was arrested by Flathead Tribal Police on outstanding warrants July 28, 2013. A small amount of suspected methamphetamine was found in her wallet. The State Crime Lab confirmed the substance was methamphetamine. 

A jury trial was set for Feb. 23, 2015. An omnibus hearing was set for Dec. 18. 

Reba Ann Hawkins, 26, Polson, pleaded not guilty to felony assault on a peace or judicial officer. According to court documents Hawkins failed to pull over as a lake County Sheriff’s Deputy tried to initiate a traffic stop on Sept. 21 on Hwy. 93. Hawkins then fled toward Pablo on dirt roads at speeds exceeding 90 mph. In Pablo Hawkins changed vehicles and continued to elude officers. A deputy chased Hawkins down on Old Hwy. 93 as she ran through a stop sign at the intersection of Old Hwy. 93 and Hwy. 93. 

Hawkins was allegedly traveling more than 100 mph as she approached Ronan. A semi-truck was forced to break hard to avoid a collision with Hawkins as she ran a second stop sign at another Hwy. 93 intersection.

Hawkins was eventually cornered at the end of a dead end road near North Foothills Drive, where she turned her vehicle around and rammed into a sheriff deputy’s patrol car. The car was damaged and the deputy was injured. 

Hawkins then rammed the car into another patrol vehicle and caused injury to another deputy. The deputies were treated at St. Luke Community Hospital. 

A jury trial was set for Feb. 9. An omnibus hearing was set for Dec. 11. 

Marlene Rae Antiste, 39, Pablo, pleaded guilty to criminal possession of dangerous drugs, a felony. Sentencing was set for Dec. 11. 

According to court documents methamphetamine and drug paraphernalia were found in a Feb. 6 search of Antiste’s vehicle conducted by Flathead Tribal Police. 

Leonard F. White, 65, Elmo, had a suspended sentence revoked. He was committed to Montana State Prison for the remainder of his sentence. He will receive credit for time served. 

White was placed on probation Nov. 5, 2013, after being sentenced Feb. 13, 2013 to five years in the Department of Corrections for felony driving under the influence, fourth or subsequent offense. White violated probation by not entering into a program to cope with chemical dependency, failing to obtain employment and failing to meet with his probation officer. 

Judge James A. Manley dealt with the following cases Oct. 29: 

Taija Rae Collier, 27, Polson, pleaded not guilty to felony criminal possession of dangerous drugs. An omnibus hearing was set for Jan. 7, 2015. A jury trial was set for Feb. 17, 2015. 

According to court documents Collier was stopped at the National Bison Range on May 2, 2013 after a brief pursuit by Lake County Sheriff’s Office and Flathead Tribal Police Officers. A search of the vehicle found a pack that contained drug paraphernalia and a crystalline substance believed to be methamphetamine. Collier said everything in the pack belonged to her except the drugs. 

Sonny Morigeau, 37, address unspecified, pleaded not guilty to felony criminal possession of dangerous drugs. An omnibus hearing was set for Jan. 7. A jury trial was set for Feb. 17. 

According to court documents Flathead Tribal Police found small packages of methamphetamine inside Morigeau’s clothes as he was being processed at Tribal Jail for unrelated charges. 

Kenneth Lester Murphy, 44, Kent, Washington, entered into a plea agreement and was found guilty of felony driving under the influence of alcohol, fourth or subsequent offense. 

Sentencing was set for Dec. 10. 

According to court documents Murphy was stopped by a Flathead Tribal Officer as Murphy tried to enter the Arlee Powwow Grounds on July 4. The officer noticed Murphy’s speech was slurred. A Lake County Sheriff’s deputy conducted field sobriety tests that Murphy performed poorly on. Murphy provided a .234 breath sample and was transported to Lake County Jail, where he provided a .206 breath sample. 

Robert Joseph Parot, Jr., 37, Polson, pleaded not guilty to felony driving under the influence, fourth or subsequent offense, misdemeanor required motor vehicle insurance, and misdemeanor driving while license suspended or revoked. 

According to court documents, a Polson Police officer responded Sept. 7 to a 911 call from a driver who said she had been hit by another driver at Hwy. 93. 

The victims told the officer that Parot had hit them. Parot told officers he didn’t have a driver’s license or insurance. The officer noted Parot’s eyes were glassy and his speech was slurred. Parot performed poorly on field sobriety tests and provided a .163 breath sample. 

Parot has three prior DUIs. 

Lance Tyler Mix, 26, Polson, pleaded not guilty to felony incest. 

According to court documents, a young child told her mother on Aug. 15 that a man had touched her inappropriately and had made her touch him inappropriately multiple times. She also described other sexual acts that had taken place in several different venues. A forensic examiner found the girl had a history of being sexually abused. 

A jury trial was set for Feb. 17. An omnibus hearing was set for Jan. 7 

Matthew Lawrence Mahkuk, 34, Pablo, pleaded not guilty to felony possession of dangerous drugs.

According to court documents Mahkuk lied to CPS officers to conceal the presence of someone in a home that the CPS wanted to speak with on Oct. 8. 

An officer searched the home and found ammunition, which was a violation of Mahkuk’s probation. Probation and parole officers found a glass pipe in Mahkuk’s bedroom that later tested positive for methamphetamine. 

Robert Stokes, 31, Elmo, in a plea agreement admitted committing the offense of criminal endangerment. Sentencing was set for Dec. 3.

According to court documents a woman who had been released from jail earlier on Jan. 6, 2014 reported to police that after she went home and was sleeping when she was awakened by someone grabbing her arm and pulling her to her knees. The woman felt something being pressed against the back of her head and heard a male voice say “What’s up?” The woman recognized the voice as that of Stokes. 

The woman looked over her shoulder and saw Stokes standing behind her with some sort of cloth covering his head. She realized Stokes was holding a gun to her head. The woman told Stokes to get out of her house and the gun went off. The woman ran out of the house and ran to another home to call for help. 

A .40 caliber bullet casing was found in her bedroom. A bullet hole was also in the heat register. 

The plea agreement also covers a May 25 incident where Stokes led officer on a 23-mile, 100 mph chase through Pablo. Stokes drove other vehicles off the road during the incident before it ended in a Sanders County field. 

Deputies fired shots at the car in order to try and stop it once it entered the field. Stokes attempted to flee on foot before he was caught. 

Patience Salois-Yonkin, 18, Ronan, in a plea agreement admitted committing felony criminal endangerment. Sentencing is set for Dec. 3. 

According to court documents on June 26 a Lake County Sheriff’s deputy was dispatched to a report of two men wrestling next to a red car on Back Road near Polson. 

The deputy noticed a red car on Light Road and a female walking in a field next to Back Road. The deputy stopped Salois-Yonkin, driver of the red car. Salois-Yonkin had blood on her arms, hands, and pants. Salois-Yonkin admitted to having beaten a person that had been riding in her car. The victim had asked Salois-Yonkin if she wanted to buy marijuana. Salois-Yonkin told the victim she did not smoke marijuana and told the victim to get out of her car. Salois-Yonkin punched the victim and kneed her in the face before the victim fled to a nearby field. 

The victim was located in the field bloodied, and with a swollen nose. 

The victim admitted to the deputy that she had wanted to sell drugs to a friend of Salois-Yonkin’s, who witnessed the crime. The victim told officers she was willing to lose $150 worth of marijuana, but not her life. 

Deputies found texts on Salois-Yonkin’s phone where she asked the victim if she could “blaze” with the victim. 

Randall Carpentier, age and address unknown, in a change of plea admitted committing felony criminal possession of dangerous drugs. Sentencing was set for Dec. 3. 

Tyler Frederick Erickson, 21, Polson, received a three-year deferred sentence after being brought to court for a probation violation. 

Dominic Prichard, age and address unknown, in a change of admitted committing felony criminal mischief and misdemeanor criminal mischief. Sentencing is set for Dec. 3. According to court documents Prichard was located in a blue car traveling Hwy. 93 that matched the description of one that had been reported by 911 callers as being beaten by a man with a baseball bat. 

Witnesses told officers that they observed a man throw a baseball bat at the car while it was traveling down the road. It caused a dent in the car and spun into the driver’s rear window before it landed in the back seat. 

The owner of the car said Prichard had taken it without permission.
