Lake County District Court news for Feb. 4, 2015

Judge James A. Manley dealt with the following cases Wednesday, Jan. 28:

Christopher James Irvine, 40, Pablo, in a change of plea admitted committing criminal possession of dangerous drugs, a felony. The court found Irvine guilty and sentenced him to the Department of Corrections for three years, with none suspended. 

According to court documents, charges stem from a July 2011 incident where methamphetamine was found in Irvine’s possession when a Flathead Tribal Police officer stopped the vehicle, in which Irvine was a passenger.

Brian Wollam, 35, Charlo, was sentenced to DOC for five years for felony criminal endangerment and to Lake County Jail for six months for a misdemeanor charge of false alarms to agencies of public safety. All time in both cases is suspended.

According to court documents, charges stem from a January 2013 incident where Wollam had called 911 to report that his friend had rolled his Jeep on black ice, there were three people inside, and they could not find one person. He also told dispatch there was blood all over the Jeep. Because Wollam wouldn’t tell the location of the rollover, officers were dispatched all over the southern end of Lake County, where roads were covered in black ice. Eventually the truth came out that there wasn’t a crash. Wollam had concocted the story and made fake calls because he was supposed to fix a woman’s car, but had avoided it by telling her he was in a wreck. When she offered to call 911, rather than be caught in a lie, he called 911 himself and then the fake story took off.

Brett William Reum, 27, Polson, pleaded not guilty to guilty to two charges of felony criminal possession of dangerous drugs. An omnibus hearing is set for March 18 and a jury trial for May 4. 

According to court documents, charges stem from a Jan. 7 incident where Reum was detained on an unrelated matter, and methamphetamine was found in his possession, along with pipes, baggies, a fully loaded Glock and $1,480 cash.

Brandon Richmond Turner, 24, Somers, pleaded not guilty to sexual intercourse without consent, a felony. An omnibus hearing is set for March 18 and a jury trial for May 4. 

According to court documents, charges stem from a 2013 incident where Turner, in a Lake County cabin, allegedly touched a minor female, under the age of 16, and forced her to touch him. A second female minor, who refused to do what Turner asked, witnessed the confrontation. Because the girls feared  repercussions to other family members, the incident wasn’t reported until the first minor was confronted about her signs of depression. 

Delicia Faye Blackweasel, 21, Pablo, in a change of plea admitted committing the offenses of felony criminal endangerment and felony theft. The court found Blackweasel guilty. Sentencing is set for March 4.

According to court documents, charges stem from a November 2014 incident where Blackweasel stole a 2003 Chevy Impala and led a Lake County deputy on a high-speed chase down North Foothills Road in Ronan, which continued onto Terrace Lake Road and Round Butte Road before she was apprehended with the use of a taser in the Ronan Middle School parking lot.

Virginia Green, 31, Ronan, (Wellpinit, Washington physical), admitted violating conditions of probation and parole and had her suspended sentence for felony criminal possession of dangerous drugs revoked. Green was sentenced to Montana Women’s Prison for five years.

Judge Deborah Kim Christopher dealt with the following cases Thursday, Jan. 29:

Patrick Lewis Lozeau, 45, Ronan was sentenced to DOC for 13 months for driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. If Lozeau completes an approved residential alcohol treatment program, the remainder of the 13 months may be served on probation.

According to court documents, charges stem from a June 2014 incident where Lozeau was stopped on Highway 93 near St. Ignatius for erratic driving and was found to be under the influence of alcohol. He was uncooperative and eventually a blood sample was collected at a local hospital.

Robert Gene Yost, Jr., 48, Dulzura, California, was sentenced to DOC for five years, none suspended, for criminal possession of dangerous drugs, a felony.

According to court documents, charges stem from an October 2014 incident here Yost was a passenger in a vehicle pulled over for a traffic stop. A cigarette pack, that Yost said was his, had a bag with methamphetamine inside. 

Aaron Todd Williams, 29, Ronan, pleaded not guilty to partner or family member assault, a felony. An omnibus hearing is set for March 26 and a jury trial for May 11.

According to court documents, charges stem from a December 2014 incident in Ronan where Williams allegedly hit his father while the father was arguing with his wife. The father had a slightly bloody lip. Williams has two prior convictions for partner/  family member assault.

Brian Keith Dawson, 46, Ronan, pleaded not guilty to partner or family member assault, a felony, and resisting arrest, a misdemeanor. An omnibus hearing is set for March 26 and a jury trial for May 11.

According to court documents, charges stem from a December 2014 incident where Ronan officers responded to a partner/family member assault in progress. Dawson said his wife attacked him and when he pushed her away, he “popped her in the lip.” An ongoing argument between Dawson and his stepdaughter ensued; as the officer attempted to calm the situation, Dawson became uncooperative. He said the stepdaughter had punched him in the face, and she said that was solely defensive. After Dawson refused the officer’s request to stay at the scene, and pulled his wrist away, Dawson began to run but was arrested after the officer tased him.

Curtis Daniel Silveria, 40, Arlee, in a change of plea admitted committing felony theft. The court found Silveria guilty, and sentenced him to six month in Lake County jail, all suspended.

According to court documents, charges stem from a September 2014 incident where Silveria broke into a shop in Arlee and stole a 100-foot welding lead. He also told officers he had previously stolen a Husqvarna chainsaw from the same shop. The items were then retrieved. Because the shop’s owner had installed a game camera, a tribal officer was able to identify Silveria as the thief.

Damen Leo James, 21, Polson, in a change of plea admitted committing theft, a felony. The court found him guilty and set sentencing for March 5.

According to court documents, charges stem from an October 2014 report of more than $6,000 in tools stolen from a work truck in Polson. After receiving a call from a pawnshop regarding suspicious tools, a Polson police officer contacted James, who said he stole the tools for the thrill of it and intended to pawn them for money.

Levi Ted Clatterbuck, 33, Ronan, in a change of plea admitted committing the offense of driving under the influence of alcohol, a felony. The court found him guilty and set sentencing for March 5.

According to court documents, charges stem from an October 2014 incident where Clatterbuck was driving 81 mph along Highway in a 50 mph zone, and in so doing, passed a Polson police officer. When the officer pulled Clatterbuck over, the officer noted the smell of alcohol and that Clatterbuck’s speech was slurred. Clatterbuck’s driving record showed at least three prior DUI convictions.
