Judge James A. Manley dealt with the following cases Wednesday, June 3:
Patrick Lee Hammer, Jr., 19, Pablo, in a change of plea admitted committing felony burglary. The court found him guilty and sentencing is set for July 15.
According to court documents, Hammer was involved with stealing items from a man’s residence in Pablo on November 14, 2014.
Jessie Kolasinski, 33, Polson, pleaded not guilty to aggravated assault, a felony. The court will issue a trial setting order.
According to court documents, On Aug. 1, 2014, Kolasinski allegedly punched a woman in the side of the face in Woods Bay, breaking the woman’s glasses. The woman had to be treated for a corneal abrasion.
Judge Deborah K. Christopher dealt with the following cases Thursday, June 4:
Alex John Jungwirth, 30, Bigfork, pleaded not guilty to driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony, and obstructing a peace officer.
An omnibus hearing is set for Aug. 20 and a jury trial is set to begin Sept. 21.
According to court documents, on April 5 a Polson Police officer pulled Jungwirth over on Highway 93 for driving about 50 mph in a 25 mph zone. As the officer approached Jungwirth’s vehicle, Jungwirth reached for a loaded revolver, causing the officer to draw his own gun and tell Jungwirth to exit the vehicle. Jungwirth, who appeared intoxicated, then provided a false name, false birth date and a false social security number to the officer, resulting in the charge of obstructing a peace officer.
A Montana Highway Patrol trooper arrived on scene and identified the driver as Jungwirth, and with the correct name dispatch was able to relay that Jungwirth was driving on a revoked license, had four previous DUI convictions, and had been on parole until two days earlier.
A passenger said he and Jungwirth had been drinking at a Polson bar. The passenger had warned Jungwirth to slow down but Jungwirth instead ran three stop signs. Jungwirth became increasingly combative as he was taken to the Lake County Sheriff’s Office, where he refused to give a breath sample and refused sobriety testing. He was eventually taken to the hospital for a blood draw, and results are pending.
Matthew Daniel Lanser, 26, Missoula, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for Aug. 13; a jury trial is set to begin Oct. 26.
According to court documents, on April 12 in Polson a Montana Highway Patrol trooper pulled Lanser over because Lanser’s brake light wasn’t working and Lanser failed to signal a turn. During a consented search of the vehicle, the trooper found a handgun, a baggie of methamphetamine in the driver’s door pocket, and methamphetamine paraphernalia in Lanser’s backpack. Another baggie of methamphetamine was found in Lanser’s jacket as he was being searched in detention.
Peter S. Aimsback, Jr., 25, address unavailable, admitted allegations of violating terms of probation and had his suspended sentence for accountability/deceptive practices revoked. He was sentenced to the Department of Corrections for three years.
Christy Lyne Urban, 29, Ronan, admitted violating conditions of probation and had her deferred sentence for bail jumping revoked. She was sentenced to DOC for three years with none suspended.
