Judge James A. Manley dealt with the following cases Wednesday, July 29:
Frank Carl Hayes, Lake County Jail, pleaded not guilty to felony aggravated assault. A jury trial is set for Dec. 14.
According to court documents, on June 3 a sheriff’s deputy learned that there had been a fight between inmates and that the victim was “ganged up on by seven cellmates.” The victim was transported to the hospital with serious injuries where medical professionals determined the victim suffered a medial right orbital fracture.
Prior to being transported, the victim gave a statement saying that he started exchanging words with Hayes, and the two went into an area of the cell that is not covered by surveillance cameras in order to “handle what needed to be handled” when he was jumped by Hayes, Randall Michel, Tyler Erickson, Michael Garza, Samuel Spottedeagle, and Peter Aimsback.
Emery John Smith II, 41, Ronan, was sentenced to six months in Lake County Jail, all suspended except time served, for partner or family member assault. He was ordered to pay $1,000 restitution with all but $100 suspended, to complete dependency treatment, and to have no contact with victim, among other requirements.
Stacey Ann Twoteeth, 48, Arlee, pleaded not guilty to vehicular homicide while under the influence, a felony. A jury trial is set for Dec. 14.
According to court documents, on July 12, 2014, a Montana Highway Patrol Trooper responded to a one-vehicle crash on Jocko Road near Arlee. From evidence at the scene and through witnesses the trooper determined the vehicle had traveled west on Jocko Road at a high rate of speed and drifted into a barrow ditch before the driver, Twoteeth, overcorrected, sending the Ford Ranger across the road before it hit an irrigation ditch and power pole. The vehicle flipped one time and ejected Twoteeth and the passenger. The passenger died of blunt force trauma from the crash, according to the state coroner.
A blood draw determined Twoteeth’s blood alcohol concentration was .203.
Danny L. Harris III, 18, Ronan, pleaded not guilty to felony robbery and felony criminal mischief. A jury trial was set for Sept. 14.
According to court documents, a female allegedly was used to lure a male to the end of Mud Lake Trail to “have sex” with him. But when the male parked with the woman, two juveniles drove up and broke the windows and began assaulting the male with a dog toy — a rope with a knot and ball on one end. The male called 911 before one juvenile took the male’s phone and threw it in the canal. As the male tried to flee, the juveniles choked, punched and kicked the male. Harris, the only adult, was also at the scene and left with the woman and the two juveniles. When law enforcement pulled the vehicle over, Harris denied knowing anything about the incident. A juvenile said they beat up the male because Harris believed the male had stolen something from him.
Tarakay L. Edner, 31, Polson, pleaded not guilty to felony assault on a peace officer. An omnibus hearing is set for Sept. 16 and a jury trial is set for Dec. 14.
According to court documents, an MHP trooper responded to a call of a man and woman fighting. The front door had several hatchet marks, and he could hear wrestling behind the door. When the trooper opened the door, Edner walked toward him with a hatchet in her hand. The trooper drew his service weapon and warned her to drop the hatchet, but she kept approaching. After warning her again, he fired his taser at her.
Aaron Daniel Morgan, 32, St. Ignatius, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for Sept. 16. A jury trial is set to start Dec. 14.
According to court documents, on Feb. 15 Morgan was stopped because a headlight was not working on the vehicle he was driving. The officer smelled alcohol and during a pat-down search found a pipe with burned marijuana. A methamphetamine pipe with meth inside was found during a search of the vehicle, as was a rifle wrapped in a blanket.
Jacob Michael Albright pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for Sept. 16. A jury trial is set to start Dec. 14.
According to court documents, in St. Ignatius on Aug. 18, 2012, a citizen called in the vehicle driven by Albright as a possible DUI. A tribal officer observed Albright nearly drive into a bridge, a parked car, and then drive in the wrong lane of traffic. Albright told the officer he had just dropped his children off at day care and seemed confused as to what day it was. Albright later admitted he had taken two lorazepams, snorted two hydrocodone tablets, drank a “bunch of alcohol” and ingested marijuana.
Leighann Michel, 25, Pablo, in a change of plea admitted committing an amended offense of felony criminal endangerment. The court found her guilty and set sentencing for Sept. 9.
According to court documents, Michel, who was driving on revoked license with three prior DUI convictions, was detained for a traffic stop and appeared highly intoxicated. She stated she was pregnant and that it was her boyfriend’s fault that she was driving. She performed poorly on field sobriety tests and a blood draw determined her BAC was .244.
Anthony J. Frazier, 33, Coram, had his suspended sentence for criminal possession of dangerous drugs revoked, and he was sentenced to the Department of Corrections for three years.
Trevor Gardipe, 19, had his deferred sentence for burglary revoked. He was sentenced to DOC for four years with none suspended.
Marlene Rae Antiste, 39, Polson, pleaded not guilty to criminal possession of dangerous drugs, child criminal endangerment, and driving under the influence of alcohol or drugs, all felonies.
An omnibus hearing is set for Sept. 16. A jury trial is set for Dec. 14.
According to court documents, Antiste was pulled over for driving in the wrong lane of traffic. There was a 5-month-old baby in the passenger seat in a car seat that was not buckled nor properly restrained. Antiste was fidgety, speaking very rapidly, and showed additional signs of drug impairment. Dispatch confirmed she had a warrant for her arrest for possession of methamphetamine. A snort tube with methamphetamine was found in her purse, and she admitted to recently using meth.
Clyde Ramsey Madgwick, 32, Polson, pleaded not guilty to driving under the influence of alcohol or drugs, fourth or subsequent offense. An omnibus hearing is set for Sept. 16. A jury trial is set for Dec. 14.
According to court documents, on May 30 Madgwick allegedly crashed his vehicle on Pablo West Road and then ran and hid in a field of tall grass. When a Lake County Sheriff’s deputy found him and asked why he was hiding, he said he had three prior DUIs and was scared, but that he was not the driver. Madgwick’s eyes were bloodshot and blurry, and his speech was slurred. When asked for a urine sample at the hospital, he dumped the sample out.
