Lake County District Court news for Oct. 28, 2015

Judge James A. Manley dealt with the following cases Wednesday, Oct. 21:

Cyle Ramsey Madgwick, 32, Polson, for a conviction of felony driving under the influence of alcohol or drugs was sentenced to the Department of Corrections for 13 months to be placed in an appropriate facility, followed by three years in DOC with all time suspended. 

According to court documents, on May 20 Madgwick crashed the vehicle he was driving in Pablo while under the influence of alcohol.

Andrew William Samsel, 31, Polson, pleaded not guilty to burglary and theft, both felonies. An omnibus hearing is set for Feb. 3, 2016 and a jury trial is set to start March 14, 2016.

According to court documents, Ronan residents reported that their home had been entered and numerous items were taken, including a zebra statue and a chocolate diamond necklace. Also taken from outside were a boat motor and a chainsaw. Samsel denied going into the house or taking items, but the zebra was recovered from a female that told detectives she got it from Samsel. A few days after  Samsel was interviewed, the boat motor and diamond necklace was turned over to a detective by Samsel’s relative. 

Daphne  G. Mitchell, 40, Polson, pleaded not guilty to criminal possession of dangerous drugs, felony. An omnibus hearing is set for Feb. 3, 2016, and a jury trial is set to start March 14, 2016.

According to court documents, on Aug. 17 Mitchell was a passenger in a car that was stopped by a Lake County Sheriff’s Deputy. She had a warrant for her arrest, and a pipe containing methamphetamine was found next to where she was sitting.

Melissa Chantel Heavner, 21, Missoula, pleaded not guilty to criminal possession of dangerous drugs, a felony, and criminal possession of drug paraphernalia, a misdemeanor. An omnibus hearing is set for Jan. 13 and a jury trial is set to begin Feb. 16.

According to court documents, Heavner was a passenger in a vehicle whose driver had stopped to see if a Lake County Sheriff Deputy needed assistance. The deputy’s vehicle was parked along Highway 35. The driver had a warrant for his arrest, and upon searching the driver’s vehicle, the deputy found two baggies and a variety of drug paraphernalia. Heavner told the deputy that she and the driver had been injecting meth inside her left elbow, showed the Deputy her injection sites, and said the meth jointly belonged to the both her and the driver.

Harley A. Hulford, 30, Ronan, pleaded not guilty to criminal possession of dangerous drugs, a felony.  An omnibus hearing is set for Jan. 13 and a jury trial is set to begin Feb. 16.

According to court documents, Hulford was arrested on a warrant Sept. 23. A baggie of meth was located in his wallet.

Jose Maseo Nishikawa, 31, Perris, California, in a change of plea admitted committing partner or family member assault, a felony. The court found him guilty. Nishikawa has two prior convictions in California for partner/family member assault. He was released and instructed to return for sentencing on Nov. 25.

According to court documents, on May 24 Nishikawa pulled his girlfriend out of a car by her hair and her jacket, pulling her onto the pavement in a Polson parking lot, causing injuries to her arms and neck. The girlfriend said they were in an “on-again, off-again” relationship.

Michael Junior Garza, 33, Arlee, in a change of plea entered a no-contest plea for an amended offense of assault, a misdemeanor. The court found him guilty and sentenced Garza to Lake County Jail for six months with all suspended but time served.

According to court documents, Garza was allegedly one of six cellmates that attacked another inmate in Lake County Jail on June 3.

William Joseph Williams, 33, Polson, admitted violating conditions of probation and parole by using meth, and had his suspended sentence revoked. He was sentenced to DOC for four years with none suspended and recommended he be screened for the Nexus program. 

Patience Salois-Yonkin, 20, Ronan, admitted violating conditions of probation by smoking marijuana and had her suspended sentence revoked. Sentencing was set for Nov. 4.

Jordan Pluff, 22, Polson, pleaded not guilty to six charges, including two counts of aggravated burglary, both felonies; two counts of felony theft; one count of felony burglary; and criminal mischief, a misdemeanor.

Because Manley and Judge Kim Christopher have recused themselves, the court will see what judge will take jurisdiction and a jury trial will be set at a later date.

According to court documents, Pluff is allegedly involved in burglaries of three residences in Polson and Finley Point between Aug. 10 and Oct. 3.
