Judge James A. Manley dealt with the following cases Wednesday, Dec. 9:

Lois Ann Friedlander, 55, Dayton, pleaded not guilty to tampering with or fabricating evidence, a felony, and tampering with witnesses or informants. An omnibus hearing is set for March 30, 2016 with a jury trial set to start May 2, 2016.

According to court documents, on June 20 a 13-year-old female reported that a 16-year-old male who was staying in the same home had had sexual relations with her in several locations in the house during the previous night. When the girl told Friedlander, Friedlander did not take the girl to be examined or interviewed, but told the girl not to tell anyone else, to keep it in the family. Friedlander made the girl and boy apologize to each other for what had happened. On July 7, another relative reported the incident. As a result of the delay in reporting the incident to proper authorities, evidence of sexual intercourse without consent on June 19 was lost. Friedlander works for Tribal Family Services and is a mandatory reporter.

Robert Ryan Compean, 22, Othello, Washington, pleaded not guilty to criminal possession of dangerous drugs. An omnibus hearing is set for March 30, 2016 with a jury trial set to start May 2, 2016.

According to court documents, on Oct. 4 Compean was stopped for speeding and methamphetamine was found in the vehicle.

Mark William Ardis, 24, Ronan, pleaded not guilty to two counts of felony criminal child endangerment. An omnibus hearing is set for March 30, 2016 with a jury trial set to start May 2, 2016.

According to court documents, on July 27 Ardis was walking down Round Butte Road with his 4-year-old and 3-year-old children after rolling his vehicle and leaving it overturned on the roadway. A blood sample revealed Ardis’ BAC was .183. 

Dominic Antonio Martinez, 23, Elmo, pleaded not guilty to three counts of partner or family member assault, third offense, all felonies. An omnibus hearing is set for March 30, 2016 with a jury trial set to start May 2, 2016.

According to court documents, Martinez allegedly hit the same woman on three occasions: on March 30 in Elmo, where she was found bloody with an open ear wound and bruise on her arm; on June 30 in Pablo where he kicked her in her leg; and on July 5 in Pablo where he shoved her and poured beer on her.

The woman said she and Martinez have been in a relationship for several years.

Lamonte Brown, 26, Ronan, pleaded not guilty to partner or family member assault, a felony. An omnibus hearing is set for Feb. 3, 2016 with a jury trial set to start March 14, 2016.

According to court documents, on Oct. 23 Brown allegedly assaulted a female with a bat, hitting her in the back of the head after an argument. Brown has two prior convictions for PFMA.

William Robert Hocker, Jr. and Russell Hocker both pleaded not guilty to assault with a weapon, a felony. An omnibus hearing is set for March 30, 2016 with a jury trial set to start May 2, 2016.

According to court documents, on June 7 a disturbance between 5 or 6 individuals was reported on North Foothills Road.  A resident said Hocker, Jr., and Russell Hocker rode an ATV at 70 mph down the road, then allegedly were in a neighbor’s field. The reporting party shut the gate to keep the ATV riders inside until law enforcement arrived, but the riders allegedly tried to drive through the gate, allegedly running over the reporting party and injuring his leg while damaging an irrigation pipe.

Andrew William Samsel, 31, Polson, pleaded not guilty to felony burglary. An omnibus hearing is set for March 30, 2016 with a jury trial set to start May 23, 2016.

According to court documents, Samsel allegedly removed property from an unoccupied Polson home where the owners are both in nursing homes. Items reported missing included a safe that contained thousands of dollars in coins, sheets of money, and loose birthstones, among other items.

Gregg Webster, 49, Polson, for felony DUI was sentenced to the DOC for three years, all suspended, plus 13 months.

Roxanne M. Acevedo, 55, St. Ignatius, for felony DUI was sentenced to the DOC for three years, all suspended, plus 13 months. 

 

Judge James Manley dealt with the following cases Wednesday, Dec. 16:

William A Koso, 38, was sentenced to the Department of Corrections for five years with none suspended for driving under the influence of alcohol or drugs, fourth offense, a felony, after a suspended portion was revoked Dec. 9. Per a plea agreement, charges of criminal endangerment had been deferred in July 2013.

According to court documents, on May 10, 2013, a Lake County sheriff’s deputy had to steer out of the way of a vehicle driven by Koso, driving in the middle of the road with a smashed windshield. When attempting to stop him, Koso veered into a ditch, took out a fence post and hit a telephone pole. Inside the vehicle were three “crying and scared kids,” ages 8, 3, and 1. The older children were not wearing seatbelts, and the 1-year-old was belted in but not properly restrained. The 8-year-old had injured his lip in the crash. Koso’s breath sample was .161 blood alcohol level, and he had three prior DUI convictions.

Matthew G. Manyhides, 27, was sentenced to DOC for five years with none suspended for DUI, fourth or subsequent, a felony, and an amended misdemeanor controlled substance charge. Manyhides was also sentenced to 13 months to be placed in an appropriate treatment facility. 

According to court documents, on June 3, 2014, a Montana Highway Patrol officer found Manyhides in his vehicle in a ditch. He blew a .110 on the Intoxilizer, and said he was celebrating because he had learned that Tribal Police were understaffed. When arrested Feb. 6 on an outstanding warrant, meth residue was found in a pipe in his pocket.

Judge Manley said treatment for Manyhides’ drug and alcohol addiction problem would give Manyhides “the opportunity to find other things to celebrate.”

Randell Runsthrough, 28, was sentenced to DOC for three years, all suspended, for criminal possession of dangerous drugs, a felony. 

According to court documents, on March 11, 2014, a confidential informant purchased two bags of meth for $100 from Runsthrough. The sale was monitored by the North West Drug Task Force. 

Mariah Barber, 20, Ronan, pleaded not guilty to two counts of criminal possession of dangerous drugs, both felonies. An omnibus hearing is set for March 30, 2016, and a jury trial is set to start May 2, 2016.

According to court documents, on June 1, 2013, the vehicle Barber was driving was stopped because the registration was not current. Marijuana and meth were found in her car.

Billie Jo Foxy McDougall, 23, Hot Springs, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for March 30, 2016, and a jury trial is set to start May 2, 2016. A request for reduction in bond to be released on her own recognizance was denied by the court.

According to court documents, on April 23 McDougall’s vehicle was stopped after a 911 call indicated McDougall was chasing another vehicle and was “tweaking.” Officers found a marijuana pipe on the driver’s seat and marijuana in a cylinder.

Shawn Michael Cooper, 31, pleaded not guilty to burglary, a felony; and theft, a felony. An omnibus hearing is set for March 30, 2016, and a jury trial is set to start May 2, 2016. The court denied a request to be released.

According to court documents, Cooper allegedly entered a Polson home three times and removed property. The homeowners are both in nursing homes. Items reported missing included a safe that contained thousands of dollars in coins, sheets of money, and loose birthstones, among other items.

Cindy Lynn Umphrey, 53, Ronan, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for March 30, 2016, and a jury trial is set to start May 2, 2016. The court granted a request for Umphrey to be released on her own recognizance.

According to court documents, a probation search was conducted on Umphrey’s residence on Nov. 4 and methamphetamine was found in a pouch in Umphrey’s room.

Pete Robert Lapham, 31, Ronan, pleaded not guilty to partner or family member assault, third offense, a felony. An omnibus hearing is set for March 30, 2016, and a jury trial is set to start May 2, 2016. The court granted a request that Lapham be released with 24/7 monitoring.

According to court documents, on Nov. 29 Lapham called 911 and said he needed to be arrested. A woman got on the phone and told dispatch that Lapham was intoxicated and needed to be removed from the residence. When law enforcement arrived, the woman said she and Lapham have been together four years, and during an hour-long argument he threatened to slap her neck, hit her and had thrown things at her. Lapham’s two prior PFMA convictions were from Missoula in 2007 and 2009.

Mitchell Joe Bear Azure, 35, Ravalli, in a change of plea admitted driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. Sentencing is set for Jan. 20, 2016.

According to court documents, on April 29 a tribal officer observed Azure driving 82 mph in a 35 mph zone along Highway 93 in Arlee, crossing the fog line multiple times. Azure appeared intoxicated and failed field sobriety tests.

Roger Andy Pablo, Jr., 34, was sentenced to DOC for five years with two suspended for an amended offense of criminal endangerment, a felony. Pablo had changed his plea to guilty in Manley’s court on Dec. 9. 

Pablo, who apologized to the court and thanked the court for releasing him to see his family prior to sentencing, faces sentencing on four additional counts in Judge Christopher’s court.

According to court documents, on June 3 Pablo was one of several inmates involved in a fight in Lake County Jail, where an inmate was beaten up.

 

Judge Deborah Kim Christopher dealt with the following cases Thursday, Dec. 17:

Roger Pablo, Jr., 34, on a revocation was sentenced to five years in Montana State Prison for criminal possession of dangerous drugs, a felony. The sentence will run consecutively to his DOC commitment pronounced a day earlier in Manley’s court. 

According to court documents, marijuana was found in Pablo’s vehicle. Aware he was on felony probation, a search of his residence revealed numerous items of drug paraphernalia with meth residue.

Dalton Lee Collier, 25, Polson, had his sentence for felony criminal possession of dangerous drugs deferred for two years. 

According to court documents, Collier’s vehicle was stopped for traffic violations on Feb. 13, 2013. Inside the vehicle officers found a Sharpie marker that contained a hidden syringe, another syringe, a spoon with meth residue, and empty baggies.

Angela Dawn Hawkins-Martinez, 42, Pablo, was sentenced to Montana State Prison for 10 years with five suspended to the DOC of five years, to run consecutively, for felony DUI. According to court documents, when Hawkins-Martinez was arrested Sept. 17 for driving with a BAC of .154, it was her fifth DUI. She will be sent to Elkhorn for treatment.

Leslie Joseph Baker, 50, Polson, for felony criminal endangerment was sentenced to the DOC for five years, all suspended. For felony DUI he was committed to DOC for five years, all suspended, plus 13 months. Both sentences will run consecutively.

According to court documents, Baker was driving while intoxicated and ran into a business sign, driving erratically within 10 feet of four juveniles that were walking in the area.

Nathan Mahseelah, 20, Ronan, was sentenced to the DOC for five years for criminal possession of dangerous drugs, a felony. Three other counts were dismissed per the plea agreement.

According to court documents, on June 23 Mahseelah was arrested on a warrant out of tribal court. Mahseelah had methamphetamine in his possession.

Crystal Dawn Hunt, 29, St. Ignatius, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for March 3, 2016. A status conference is set for April 14, 2016 and a jury trial is set to start May 23, 2016.

According to court documents, on March 19 Hunt was found with meth in her possession.

Zachary John Nentwig pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for March 17, 2016. A status conference is set for April 14, 2016 and a jury trial is set to start May 23, 2016.

According to court documents, on Dec. 17, 2014, a Montana Highway Patrol trooper stopped the vehicle Nentwig was driving because the tinted windows were darker than what is allowed by law. After Nentwig consented to have the vehicle searched, the trooper located $652 in cash, a pistol, a gram of meth, and several pills. In jail, Nentwig was found in possession of additional bags of meth.

Anglie Quequesah, 39, Pablo, in a change of plea admitted committing the offense of felony DUI, fourth or subsequent offense. Sentencing is set for Jan. 28, 2016.

According to court documents, on Sept. 18, a tribal officer observed Quequesah drive 50 mph in a 25 mph in Pablo, running both a stop sign and a red light. Quequesah blew a .114 on the Intoxilizer.

Kortny Gene Duback, 31, Polson, in a change of plea pleaded guilty to criminal possession of dangerous drugs, a felony. Sentencing is set for Feb. 4, 2016.

According to court documents, when Duback was booked in tribal jail on outstanding warrants March 10, he had a scale with meth residue on the surface in his possession.

Waleya Rossbach had her 2010 suspended sentence for felony criminal possession of dangerous drugs revoked for violating conditions of parole and probation. She was sentenced to the DOC for three years.
