Judge Deborah Kim Christopher dealt with the following cases Thursday, Jan. 20:
Danielle Lawler, 31, Pablo, admitted committing an amended offense of criminal endangerment, a felony. The court accepted the plea agreement and found Lawler guilty. Sentencing is set for Thursday, Feb. 24 at 9 a.m.
According to court documents, charges stem from a March 13, 2009 incident where a 9-month-old infant suffered a broken leg and bruising while in the care of Lawler, his babysitter. Lawler told the mother the baby had been a little fussy, but denied anything happened to the child. Five days later, in an interview with a detective, Lawler said she fell down the stairs and fell on the baby. She said she did not tell anyone about the incident because she was scared.
Josiah Kinyon, 20, Polson, pleaded not guilty to criminal possession of dangerous drugs, a felony, and criminal possession of drug paraphernalia and criminal possession of dangerous drugs, both misdemeanors. An omnibus hearing is set for Thursday, March 17 at 9 a.m. and jury trial is set for Monday, April 25 at 9 a.m.
According to court documents, charges stem from a December 2010 incident where a woman text messaged an officer, indicating that her daughter’s boyfriend was in her home and she was afraid. She and her husband then left their home, met with the officer, and reiterated their fears that Kinyon might try to hurt himself or someone else. After officers received permission to enter the home, Kinyon was found laying on a bed next to a glass mason jar with marijuana inside, a burnt spoon, a syringe and other drug paraphernalia.
James Wasson, 22, Ronan, was sentenced to the Department of Corrections for five years for burglary, a felony.
According to court documents, charges stem from an October 2010 incident where a woman had come home and had seen a male running from her house. Several DVD recordings and some perfume were missing from her home. A neighbor called the police to say she saw a man drop two bags over a fence; when police retrieved them, they were full of DVD movies. Wasson was later found at his girlfriend’s residence, and admitted entering the residence and stealing the DVDs.
Gyme Alan Kelly, 53, Ronan, was sentenced to Montana State Prison for 40 years with 25 suspended for driving under the influence of alcohol or drugs, a felony. A previous suspended sentence for driving under the influence of alcohol or drugs was also revoked, and the court committed Kelly to Montana State Prison for 15 years to run consecutive to the above sentence.
According to court records, Kelly was charged with his seventh offenses of driving under the influence or alcohol or drugs in 2005, and was charged again in February 2010 after being pulled over along Highway 93 in Polson.
