Judge James A. Manley dealt with the following cases Wednesday, Feb. 17:
David Jamison, Polson, per a change of plea admitted being in possession of methamphetamine on June 11, 2013. The court found him guilty of criminal possession of dangerous drugs, a felony, and set sentencing for April 14.
Shirley Felsman, 29, Charlo, pleaded not guilty to solicitation (robbery), a felony. An omnibus hearing is set for June 8 and a jury trial is set to begin June 20. A bond hearing set for Feb. 24 was vacated on Feb. 19 and Felsman was released on her own recognizance.
According to court documents, on Jan. 6, 2014, Felsman allegedly stole an eight-pack of beer from a Ronan convenience store with the help of two other women who arrived with her. One of the women tried to distract store employees by breaking a jar of salsa, falling on the floor, and saying she was having a diabetic fit. Felsman allegedly left the store, backed a car to the storefront, then re-entered the store and took beer without paying for it. When an employee tried to stop Felsman, the third woman involved allegedly grabbed the employee and threw her on her back onto the cement, causing injury.
Laura Jean Hauner, age and residence unavailable, was sentenced to the Department of Corrections for two years, all suspended, except 15 days, for an amended offense of criminal possession of dangerous drugs, a felony. Hauner will be credited for six days served, but argued that she has served 15 days total between here and Washington. If she can provide proof of more time served, the court will consider amending the judgment.
According to court documents, at a Polson residence on Nov. 5, 2013, Hauner sold $50 of methamphetamine to a confidential informant.
Judge Deborah Kim Christopher dealt with the following cases Thursday, Feb. 18:
Kelley Gordon Dupuis, 26, Pablo, admitted violating conditions of probation by not living at residence, failing to seek employment since sentencing in November 2015, failing to report to probation officer, testing positive for methamphetamine, not making payments toward court-ordered restitution in the amount of $5,122.70, failing to get drug tested, being cited for felony criminal possession of dangerous drugs, among other violations.
The court found Dupuis guilty and his deferred sentence for felony burglary was revoked. Dupuis was sentenced to the Department of Corrections for 20 years with 15 suspended, and credited for time served, with a recommendation that Dupuis be placed in the NEXUS treatment program.
“I’m not going to be lenient, but I will try to create an opportunity should you choose to take it,” Christopher said to Dupuis, who previously served in law enforcement. “You obviously know how to live a different life. You can get there if you choose to beat this drug.”
If Dupuis chooses not to fight his drug addiction, Christopher said she wants him locked up until he does. The burglary charge caused the court significant concern because his drug use is impacting others, Christopher said.
“I just need help with my drug problem, ma’am,” Dupuis told Judge Christopher.
“That’s pretty clear,” she said. “… My hope is you find yourself back to the person you were before you started this drug.”
Kenneth Lozeau, Jr., 22, Ronan, per a change of plea admitted he was in possession of a hydrocodone pill on June 9, 2014 for which he did not have a prescription. The court found Lozeau guilty of criminal possession of dangerous drugs, a felony, and set sentencing for April 7.
Jesse Shawn Uhde, 37, Lakeside, in a change of plea admitted committing the offense of assault on a minor, a felony.
The court found Uhde guilty and set sentencing for April 7. Uhde was released on the condition that he have no unwanted contact with victim, and that he is to have a discussion with probation about getting counseling for anger management. An additional felony charge of partner or family member assault may be dismissed at sentencing per the plea agreement.
According to court documents, in Rollins on Aug. 18, 2015, Uhde got mad at his girlfriend and pushed her down the stairs. She left with and walked down the road with four children, including Uhde’s 13-year-old daughter. When he demanded the daughter come with him, the daughter refused. He dragged her to the car by her hair and took her home, where she left through a bedroom window and called 911.
Kaelah Michelle O’Roake, 31, Ronan, in a change of plea admitted that on Sept. 11, 2015 she was in possession of a pipe with methamphetamine residue, admitting to the offense of criminal possession of dangerous drugs, a felony. The court found her guilty and set sentencing for April 14.
Edwin Andrew Hanson, 34, Polson, in a change of plea admitted that on Feb. 26, 2015 he was driving in Lake County while under the influence of alcohol. The court found him guilty of driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. Sentencing is set for April 14.
Lucy Tianna Parker, 23, Ronan, in a change of plea admitted that on April 2, 2015 in Ronan she was in possession a syringe that contained methamphetamine. The court found her guilty of criminal possession of dangerous drugs, a felony, and set sentencing for April 14.
