Construction company sues Polson over sewer, water project

POLSON — A Flathead County construction company is suing the City of Polson and its engineer Shari A. Johnson and Associates for breach of contract.

Sandry Construction Co. Inc. filed the suit in Lake County District Court Nov. 19. Sandry was the successful bidder for some additional work done on the Polson sewer and water replacement project.

Sandry claims that it encountered underground utilities, including storm drain crossings, that were not depicted in plans provided by the city engineer. Sandry said the plans were inadequate because they failed to identify a number of underground utilities and infrastructure.

The city and Sandry agreed that Sandry would be compensated for work done to address obstructions, according to the lawsuit.

Sandry said it submitted 15 additional documents evidencing additional labor and materials, and that the city agreed to pay only a portion of the additional expenses.

In the suit, Sandry is not asking for a specific dollar amount. Rather it asks that damages be determined at trial. The city and Johnson responded with an answer to the suit on Dec. 7, agreeing with some of Sandry’s statements and denying others.

Polson City Manager Mark Shrives declined to comment for this story. The suit is scheduled to be heard by Judge James A. Manley.
