Judge Deborah Kim Christopher dealt with the following cases Thursday, March 29:
Lydia Fisher, 50, Pablo, pleaded not guilty to driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. An omnibus hearing was set for Thursday, June 7, and a jury trial set to begin Monday, July 23. Both begin at 9 a.m.
According to court documents, charges stem from a March 7 incident where a Tribal Officer made a traffic stop of a vehicle for having a taillight and headlight out. The driver, Fisher, smelled of alcohol and performed poorly on field sobriety tests.
A breath sample showed a .065 percent blood alcohol concentration, but Fisher told the officer she also takes Lortab and “Lyterall” and that she took her medications less than three hours before driving. On the way to the jail, Fisher urinated on herself and again performed poorly on field sobriety tests at the jail. Her driving record shows she has at least three prior DUI convictions.
Laura Callahan, 31, Ronan, was sentenced to the Department of Corrections for 13 months plus two years suspended for driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony.
According to court documents, charges stem from an October 2011 incident where Callahan ran her pickup into the ditch and left the vehicle. When officers interviewed her at home, she said she must have had too much to drink. A breath test showed she had a blood alcohol concentration of .188, and records show Callahan has three prior DUI convictions.
Dylan E. Ivins, 20, Pablo, pleaded not guilty to criminal possession of dangerous drugs with the intent to distribute, a felony. Ivins remains at liberty. An omnibus hearing was set for Thursday, June 7, and a jury trial set to begin Monday, July 23.
According to court documents, charges stem from a March 7 incident where Tribal Officers made a traffic stop of a vehicle Ivins was driving. An officer smelled marijuana and saw that Ivins had marijuana in his lap. Ivins admitted there was more marijuana in the vehicle and consented to a search.
The officers found seven baggies of marijuana, a digital scale, a box of baggies, a partially consumed bowl of marijuana, a notebook with apparent drug purchase information in it, cash in varying denominations, several snort tubes and a plate with white residue on it. Ivins said he got the marijuana from his uncle, a medical marijuana cardholder, and that he intended to sell it to make money. Judge C.B. McNeil dealt with the following case Wednesday, April 4:
• Joshua Allen Brown, 30, Helena, had his 2000 suspended sentence for burglary, a felony, revoked and was sentenced to the Department of Corrections for 13 years, five suspended. The court recommended that Brown be considered for placement at the Missoula Assessment and Sanction Center if that arrangement meets with DOC approval.
According to court documents, Brown violated his probation and parole by failing to maintain employment, hiding two large knives from his foster care provider, failing to abide by the law because he gave someone a tatoo without a license, taking a benzodiazepine without a prescription, failing to remain in his mental health counseling program and failing to obtain his GED as ordered by the court.
