Judge C.B. McNeil dealt with the following cases Wednesday, Feb. 15:
Dallas Andrews, 24, Polson, had his 2009 deferred sentence for burglary, a felony, revoked and was sentenced to the Department of Corrections for 10 years, eight suspended. Andrews will receive credit for time served while in custody.
According to court documents, Andrews violated his probation by changing his residence without notifying his probation officer, failing to report to his probation officer as required, failing to enter and complete chemical dependency counseling and failing to pay court-ordered restitution and fines.
Jennifer Hammond, 30, Charlo, in a change of plea, admitted to the amended offense of reckless driving, a misdemeanor. She was found guilty and sentenced to 90 days in the Lake County Jail, all suspended.
Jimmy Graham, 54, Ronan, was sentenced to the Department of Corrections for five years, all suspended but 30 days in the Lake County Jail, to be served within 120 days, for criminal possession of dangerous drugs, a felony.
According to court documents, charges stem from a December 2010 incident where a tribal officer on patrol in Ronan observed Graham get out of a vehicle near Town Pump and throw an object onto the ground. The officer retrieved the item, and discovered a pouch that contained a number of small plastic bags containing a white powder consistent with methamphetamine. Graham was arrested, and the substance was confirmed to be methamphetamine by the state crime lab.
Roy Shostak, 42, Ronan, was sentenced to the Department of Corrections for six years, all suspended but 14 days in the Lake County Jail to be served within six months, for criminal endangerment, a felony.
According to court documents, charges stem from an April 2011 incident where a Ronan Police Officer stopped Shostak when the vehicle he was driving allegedly swerved across the center line and accelerated to 40 mph in a 25 mph zone on Round Butte Road. Shostak got out of his vehicle, approached the officer and asked the officer to take him to jail since he didn’t have a driver’s license. Shostak performed poorly on sobriety tests at the scene and later at the Lake County Jail.
Shostak’s girlfriend was in the vehicle and also intoxicated, and his 3-year-old son was in a booster seat in the back seat of the vehicle. Shostak’s driving record revealed three prior convictions for driving under the influence of alcohol or drugs, and Shostak was declared a habitual traffic offender on April 9, 2008.
Savonnah Ryan, 24, Ronan, received a four-year deferred sentence for criminal possession of dangerous drugs, a felony.
According to court documents, charges stem from a February 2011 incident where Flathead Tribal Police arrested Ryan on outstanding warrants. Ryan admitted to the Montana Highway Patrol Trooper transporting her to Lake County Jail that she had methamphetamine in her shoe. Ryan handed the trooper a plastic Ziploc bag containing a white crystalline substance. The Ziploc bag had green $ signs on it, and similar bags had been found in the vehicle Ryan was in prior to her arrest.
Francois Burke, 39, Polson, had his 2008 probation for driving under the influence of alcohol or drugs, fifth offense, a felony, revoked and was sentenced to the Department of Corrections for three years, two suspended. He will receive credit for time served while in custody.
According to court documents, Burke violated his probation when he tested positive for THC, the active chemical compound in marijuana, in December 2011.
