Judge C.B. McNeil dealt with the following case Wednesday, Sept. 12:
Francois Pepion, 35, Arlee, was sentenced to the Department of Corrections for 13 months followed by two years suspended for driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. He will receive credit for time served while in custody.
Judge Deborah Kim Christopher dealt with the following cases Thursday, Sept. 13:
Jeremy Rice, 33, Polson, had his Aug. 23, 2012, suspended sentence for threats and improper influence in political matters, a felony, revoked and was sentenced to the Department of Corrections for five years, two suspended. The court recommended that Rice be considered for inpatient chemical dependency treatment.
According to court documents, since Aug. 28, Rice violated his probation by possessing 106 rounds of .45 caliber ammunition; using alcohol, marijuana and prescription pills (which he liquefied and injected with a hypodermic needle); and allegedly overdosing on a unknown drug on Aug. 28 after he signed his rules of probation.
Lionel Shepherd, 34, St. Ignatius, pleaded not guilty to driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. An omnibus hearing was set for Thursday, Nov. 25, and a jury trial set to begin Monday, Jan. 22. Both begin at 9 a.m.
According to court documents, the charge stems from a Sept. 3 incident where Shepherd was stopped for driving 45 miles per hour in a 65-mph zone on U.S. Highway 93 in Ronan just after midnight. Shepherd had three empty bottles and two unopened bottles of Mike’s Hard Lemonade in the vehicle. He refused field sobriety tests and a breath sample. The arresting officer obtained a search warrant for Shepherd’s blood, and the sample was sent to the state crime lab for analysis. Shepherd has at least three prior DUI convictions on his driving record.
Ashley Justice, 22, Tense, Idaho, was sentenced to the Department of Corrections for five years, three suspended, for criminal possession of dangerous drugs, a felony.
