Judge Deborah Kim Christopher dealt with the following cases Thursday, Dec. 6:
Reba Ann Hawkins, 24, St. Ignatius, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing was set for Thursday, Feb. 7, at 9 a.m.
According to court documents, the charge stems from a July 31 incident where Hawkins was stopped by a Montana Highway Patrol Trooper and the vehicle she was driving was seized. She consented to a search of her purse, where an officer found a pill crusher with white powdery residue on it, a glass stimulant pipe, a vinyl case containing two small plastic baggies with apparent methamphetamine in them, several snort tubes, a razor blade and multiple other baggies. Hawkins stated she had smoked 1/4 gram of methamphetamine, snorted a 7.5 milligram Lortab pill, drank one Bud Light beer and smoked three “hits” of marijuana in the previous six hours. A blood sample was sent to the state crime lab for analysis.
Shane Johnson, 38, was sentenced to the Department of Corrections for two years, all suspended, for issuing a bad check, common scheme, a felony. He was also ordered to pay $1,884.70 in restitution.
According to court documents, charges stem from incidences in March, July and August 2011 where Johnson allegedly wrote 83 bad checks to seven different Lake County merchants on a checking account at Community Bank. After the county attorney’s office notified Johnson of nonpayment, he failed to make the checks good or otherwise make arrangements for repayment.
Wesley Charlo, 35, Arlee, had his May 24 suspended sentence for failure to register as a sexual or violent offender, a felony, revoked and was sentenced to the Department of Corrections for three years, none suspended. He will receive credit for time served.
According to court documents, Charlo violated his probation multiple times since May 24. He was arrested Nov. 19 for possession of dangerous drugs, a felony; he tested positive for and admitted using marijuana, methamphetamine and methadone on Nov. 20; he was in possession of a marijuana pipe on Nov. 20; and he was associating with a woman who, by her own admission, smokes marijuana.

Jason Edward David, 28, Ronan, pleaded not guilty to three counts of sexual intercourse without consent, all felonies; attempt, a felony; aggravated assault, a felony; and aggravated kidnapping, a felony. An omnibus hearing was set for Wednesday, Jan. 31, and a jury trial set to begin Monday, March 11. Both begin at 9 a.m. Bond was set at $50,000.
According to court documents, charges stem from a Nov. 24 incident where David allegedly repeatedly raped a 29-year-old deaf woman after meeting her at the Valley Club Bar and agreeing to give her a ride home. Instead, David took the woman to his house, where he told her she could not leave, threatened to kill her and forcibly raped her while holding her by the neck. The woman repeatedly called for help, and while David’s sister and niece were in the house, they did not respond. Both women told officers they heard “sex noises” coming from David’s bedroom. When David finally let the victim leave, he told her that “bad things would happen to her” if she told anyone what he had done.
The woman headed directly to the hospital on foot after leaving David’s house and called her mother, who picked up her by the hospital. The woman was in so much pain in the pelvic region that she could barely walk, and several marks and bruises on her were photographed at the hospital.
In an interview with investigators, David claimed he had done nothing wrong, but became agitated during questioning and terminated the interview. David was accused on March 28 of having non-consensual intercourse with another female he’d invited into his bedroom and was charged with sexual intercourse without consent; however, the charges were dropped pending the completion of further investigation.
Magic Johnson, 21, Polson, in a change of plea, admitted to the amended offense of forgery, a misdemeanor. He was found guilty and sentenced to six months in the Lake County Jail, all suspended, on the condition that he serves 10 days in jail within 90 days of sentencing and pays all fines and surcharges and restitution to the victim, First Citizen’s Bank.
According to court documents, the charge stems from an Aug. 22 incident where Johnson allegedly forged an unathorized check on his father-in-law’s account for $2,400 to an acquaintance whom Johnson owed money. An analysis by a forensic handwriting specialist indicated that the handwritten and numerical entries on the check were written by Johnson.
Benjamin Hoffman IV, 36, Polson, had his 2010 suspended sentence for issuing a bad check, common scheme, a felony, revoked and was sentenced to the Department of Corrections for eights years, all suspended, to run consecutive to Hoffman’s sentence in another case in Flathead County.
According to court documents, Hoffman violated his probation by changing his residence and traveling out of his district without consent from his probation officer; quitting his job without approval from his probation officer; failing to report to his probation officer as scheduled; failing to pay court-ordered restitution; and using marijuana.
