Judge C.B. McNeil dealt with the following cases Wednesday, Jan. 30:
Steven Mikkelsen, 41, Ronan, had his 2007 suspended sentence for burglary, a felony, revoked and was sentenced to the Department of Corrections for 10 years, five suspended. Mikkelsen also had his 2007 suspended sentence for driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony, revoked and was sentenced to the Department of Corrections for five years, all suspended, to run consecutive to the first sentence.
According to court documents, Mikkelsen violated his probation by changing his residence without notifying his probation officer; failing to search for or maintain employment; failing to report to his probation officer as scheduled; being cited and arrested for a felony and a misdemeanor in December 2012; consuming alcohol; and refusing a breathalyzer test.
James Wilson Allen, 37, St. Ignatius, pleaded not guilty to assault on a peace officer or judicial officer, a felony. An omnibus hearing was set for Wednesday, March 20, and a jury trial set to begin Monday, June 17. Both begin at 9 a.m.
According to court documents, the charge stems from a Jan. 10 incident where a Lake County Sheriff’s Deputy attempted to stop Allen, who was driving recklessly. Allen pulled into a driveway and the deputy pulled in behind Allen. When the deputy got out of his vehicle, Allen reversed his vehicle, spinning his tires in the snow in a attempt to hit the deputy. The deputy jumped into his car and avoided being hit by only 6 inches.
Judge Deborah Kim Christopher dealt with the following cases Thursday, Jan. 31:
Seth Nicholas Harpst, 29, Polson, had sentencing deferred for six years for theft, a felony, and was ordered to serve 60 days in the Lake County Jail within 120 days and pay $3,870.40 in restitution. Thirty days jail time will be suspended if Harpst pays half of the ordered restitution within 120 days.
According to court documents, Harpst stole several items from a man who had rented Harpst a room in his house, including a generator, coins, silver, tools, DVDs and headphones, and pawned the items, which had a total value of more than $1,500. The landlord reported to the sheriff’s office that he had located his stolen generator at Depoe Junction in Polson, and a review of other pawn tickets under Harpst’s name showed he had pawned several silver coins and tools that were also stolen from his landlord. In an interview, Harpst admitted stealing the generator and pawning it and taking other items that were not his from his landlord’s home.
Stephanie One Horn, 29, Arlee, had her 2006 suspended sentence for forgery, a felony, revoked and was sentenced to the Department of Corrections for eight years, three suspended. She will receive credit for time served while in custody.
According to court documents, One Horn violated her probation by failing to report to her probation officer as ordered; driving alcohol; failing to advise her physician of her opiate addiction; and failing to pay court-ordered restitution.
Richard Lopez, 29, Ronan, had his 2005 suspended sentence for criminal endangerment, a felony, revoked and was sentenced to the Montana State Prison for five years. He will receive credit for time served while in custody.
According to court documents, Lopez violated his probation by failing to report to his probation officer for more than two years; traveling outside of his probation district without permission; failing to pay court-ordered restitution; and being convicted of eight misdemeanors in 2011 and 2012.
Jason Thompson, 25, Kalispell, admitted to theft, a felony. Sentencing was set for March 14 at 9 a.m.
According to court documents, the charge stems from an October 2012 incident where Thompson used his parents’ debit cards and a credit card without permission and charged a total of $1,590.84 to the cards. Thompson admitted to the theft and said he would be willing to reimburse his parents.
Brian Johnston, 38, Ronan, had his 2006 suspended sentences for criminal possession of dangerous drugs, a felony, and criminal possession of dangerous drugs, a misdemeanor, revoked and was sentenced to the Montana State Prison for nine years.
According to court documents, Johnston violated his probation when he was charged with three counts of incest, all felonies, in 2011. He was convicted of two counts of incest, both felonies; solicitation of incest, a felony; and sexual abuse of children, a felony. He has also previously been convicted of failure to register as a sex offender, a felony, and criminal possession of dangerous drugs, a felony.
