Lake County District Court news for June 12, 2013

Judge C.B. McNeil dealt with the following cases Wednesday, June 5:

Micah Ashby, 35, Polson, was sentenced to the Department of Corrections for five years, all suspended, for criminal endangerment, a felony. Ashby was also sentenced to one year in the DOC, with all suspended except five days, for partner or family member assault, a misdemeanor. Ashby was also credited for five days already served, resulting in on jail time.

According to court documents, charges stem from a June 2012 incident where Ashby used force to choke a female and hit her in the eye until she lost consciousness. He also grabbed another female by the throat and forced her down the hallway. Ashby admitted to a detective that he lost his temper.

Lyman Ferguson, 38, Box Elder, was sentenced to the Department of Corrections for five years with four years suspended, and credited for time served for fraudulently obtaining dangerous drugs, a felony.

According to court documents, charges stem from a June 2011 incident where Ferguson stole a prescription pad from a clinic and attempted to get drugs from a Polson pharmacy.

Leeann Reynolds, 35, Polson, pleaded not guilty to burglary, a felony. An omnibus hearing was set for Wednesday, July 17 and jury trial was set to begin Monday, September 16. Both begin at 9 a.m.

According to court documents, charges stem from an April 26 incident where Reynolds allegedly forced her way into a Polson home, although she was asked to leave, and demanded to know if the resident’s girlfriend was pregnant. 

David Hall, 69, Polson, admitted committing the offense of driving under the influence or alcohol or drugs, fourth or subsequent offense. The court accepted the plea and found Hall guilty.

Sentencing is set for Wednesday, July 10 at 9 a.m.

According to court documents, charges stem from a Feb. 20 incident where a tribal officer pulled Hall over for swerving on Highway 93. After the officer administered field sobriety exercises and took a breath sample, Hall was arrested with a blood alcohol content of .203 percent. 

Kimberly Joseph, 41, Elmo, had her suspended sentence revoked and was sentenced to four years in the Department of Corrections with no time suspended, to be placed in an appropriate facility. Joseph also received credit for time served.

According to court documents, Joseph admitted to consuming alcohol and not reporting to her probation officer, which resulted in violating terms of her parole.

 

Judge Deborah Kim Christopher dealt with the following cases Thursday, June 6:

Lawrence Stevens, 33, St. Ignatius, pleaded guilty to driving under the influence of drugs or alcohol, fourth or subsequent offense, a felony. Sentencing is set for Thursday, July 25 at 9 a.m.

According to court documents, charges stem from a Feb. 12 incident where Stevens was pulled over for swerving all over the road, and told the officer, “You know that I’m drunk … just take me to jail.” Stevens agreed to give the officer a breath sample, with a BAC result of .267 percent. Stevens had three prior convictions.

Shilo Brown, 36, St. Ignatius, was sentenced to 10 years with five suspended, to run concurrent on three counts of assault on a peace officer. For the offense of assault with a weapon, Brown was sentenced to 10 years with all suspended. For criminal endangerment, Brown was sentenced to 10 years with five suspended. On April 25, a jury found Brown guilty on all counts.

According to court documents, charges stem from an October 2012 incident where Brown was threatening to kill another female at a home in St. Ignatius, shot one round at her but missed, and pointed a rifle at two Lake County sheriff’s deputies and a tribal officer.

James Dempsey, 41, Polson, had his suspended sentence revoked and was sentenced to the Department of Corrections for three years for criminal possession of dangerous drugs, a felony. Dempsey was also sentenced to DOC for two years for driving under the influence of alcohol, a felony.

According to court documents, Dempsey admitted that on May 8 and/or May 9, he was associating with a parole absconder, consuming alcohol, and using methamphetamines and Valium, all of which violated terms of his parole.
