Lake County District Court news for Sept. 30, 2010

Judge C.B. McNeil heard the following cases Wednesday, Sept. 22:

Luke Patrick, 36, Polson, pleaded not guilty to the charge of criminal possession of dangerous drugs, a felony. Patrick remains in custody on a $25,000 bond. Charges stem from a Sept. 3 incident when Patrick, who was on probation after serving time for robbery, allegedly would not allow his probation officer to enter his residence.

According to court records, he locked the doors and hid in the attic, but was arrested after law enforcement officers pepper-sprayed the attic area. According to court records, Patrick tested positive for the presence of methamphetamine and his SCRAM bracelet indicated he had also been consuming alcohol the same day.

An omnibus hearing is set for Wednesday, Oct. 20 at 9 a.m.

Vincent Joseph Curley, 30, Ronan, admitted to committing an amended offense of partner or family member assault, second offense, a misdemeanor. The court accepted the plea agreement. Curley was found guilty and sentenced to Lake County Jail for one year, with all suspended but 30 days with credit for two days served. Curley will also receive credit for an additional two days served in Tribal jail if he can provide proof.

According to court documents, the charges stem from an April 18 incident when police responded to Curley’s home on a report of domestic assault. At the home, police interviewed a woman who claimed Curley was coming off of a drug-induced high and was paranoid that someone was in the attic. The woman refused to go in the attic to look, so Curley retrieved a pistol and kept cocking it over and over again. 

William John Kipp, 59, Polson, pleaded not guilty to failure to register, a felony. According to court documents, Kipp, a registered transient sex offender, did not notify the Lake County Sheriff of locations where he was staying between November 2008 and September 2010, which he is required to do on a monthly basis.

An omnibus hearing is set for Wednesday, Oct. 13 at 9 a.m.

 

Judge Deborah Kim Christopher heard the following cases Sept. 23:

Jessica Lynn Lozeau, 25, Ronan, did not appear in court and the court denied a continuance requested by her attorney. According to court documents, Lozeau had been summoned to court on numerous occasions to answer a petition to revoke for violating conditions of her probation, but she has not been present. Lozeau’s probation stems from charges of fraudulently obtaining illegal drugs. The court set an adjudicatory hearing for Thursday, Oct. 7 at 9 a.m. 

David Langan aka David Westly, 28, Milford, New Jersey, changed his plea and admitted to committing burglary, a felony, and theft, a misdemeanor. The court accepted the plea and found Langan guilty. The plea stipulates Langan must pay full restitution in the amount of $10,819.73.

Sentencing is set for Thursday, Oct. 21 at 9 a.m.

According to court documents, charges stem from two April 2009 incidents when firearms and silverware valued at more than $1,000 were missing from a home on Skidoo Lane. 

The homeowners located their firearms at Jolly Pack Rat six days later, and also found their stolen silverware at Gold Rush Pawn in Kalispell. 

Another cabin on Skidoo Lane was also broken into at a later date and a variety of items were stolen and pawned.

Robert Templer, 40, Ronan, did not appear for his omnibus hearing for the charge of driving under the influence of alcohol, fourth or subsequent offense, a felony. The court advised the state to prepare a warrant of arrest. 

Timothy Polly, 38, Kalispell, pleaded not guilty to charges of theft, a felony. According to court documents, Polly allegedly stole a 2005 Dodge Stratus after the car’s owner, Mathew Payment, had driven him Minnesota. 

Polly offered to take the car to repair a tire, but never returned, and instead drove the car to Montana. 

In August, an employee of Walmart in Polson observed a man trying to steal a cart of merchandise. 

The man cut the chain locking the garden center, but left the cart and fled in a 2005 Dodge Stratus after the employee yelled at him. The employee reported the license plate number to the police and it matched Payment’s vehicle. Walmart employees later identified Polly as the man who fled Walmart in Payment’s car.

Polly remains in custody, and an omnibus hearing is set for Thursday, Oct. 7, at 9 a.m.

Harlan Vaska, 64, Missoula, was sentenced to Montana State Prison for 15 years with 10 years suspended plus a $1,000 fine for driving under the influence of alcohol or drugs, fourth or subsequent offense.

According to court documents, this was Vaska’s ninth DUI. Cydrese Hendrickx, 22, St. Ignatius, was not present for sentencing on revocation for violating probation for charges of threats and other improper influence in official and political matters, a felony. The state requested an arrest warrant be issued, and the court agreed to sign it when the state prepares the warrant.
