Judge Deborah Kim Christopher dealt with the following case July 1, 2010:
Reesa N. Popoff, 40, Polson, pleaded not guilty to felony criminal endangerment and misdemeanor DUI. An omnibus hearing was set for Aug. 5 at 9 a.m.
According to court records, the charges stem from a May 10 incident when a Montana Highway Patrol trooper responded to a two-vehicle crash in a parking lot near Polson. According to reports, a blue truck backed into a red Cadillac Escalade. There were no reported injuries.
Once on scene, the trooper noted that Popoff was uncooperative, smelled strongly of an alcoholic beverage, had bloodshot and glassy eyes and slurred speech. He also noted that she swayed badly and stumbled when she walked. Numerous witnesses also described similar behavior.
Popoff admitted to backing into the Cadillac and also admitted that her 3-year-old son was in the car during the incident. However, she refused to submit to field sobriety tests and would not provide a breath sample.
