Sheila Vallejo filled her letter to the editor on March 26 with totally egregious and false statements. For Ms. Vallejo’s benefit, here is a listing of actions and motions filed against the Jocko and Mission irrigation districts, each requiring a response from those districts:
I. Western Montana Water Users Association v. JVID, MID, Johnson, Doney, and Wadsworth:
1. WMWUA’s Writ of Prohibition. 2. WMWUA’s Second Amended Petition for Writ of Mandate and Complaint. 3. WMWUA’s Motion to Disqualify BKBH. 4. WMWUA’s Motion to Reconsider. 5. FJBC’s Motion to Disqualify BKBH. 6. Joint Motion of FJBC and WMWUA to Join Motions. 7. WMWUA’s Motion for Immediate Appointment of Receiver. 8. WMWUA’s Application for Hearing. 9. WMWUA motion for extension.
II. FJBC v. MID and JVID Commissioners (FJBC’s challenge to Districts withdrawal) Complaint to stop Mission & Jocko withdrawal from FJBC
III. FJBC’s Water Court Interpleader v. MID & JVID (water rights) (Filed in two courts)
FJBC’s Motion to Interplead and for Declaratory Judgment
IV. Roy & Sheila Vallejo & Harley Hettick v. MID and Commissioners Complaint against Districts for raising fees.
All of these actions have driven Mission district legal fees into the stratosphere. Note that Ms. Vallejo has filed one of those suits, increasing Mission legal fees even further. She claims the recall has nothing to do with the Flathead Compact, but the above list of litigation is all Compact related.
And finally, the claims in the petition were not investigated by the County Attorney. Only the form of the petition was approved. Jerry Johnson and myself are long-time, hardworking ranchers in this area. We have only worked to keep our irrigators free from long-running water litigation that will last for decades. Unfortunately, Ms. Vallejo wants to litigate everything, by her actions.
