Judge James A. Manley dealt with the following cases Wednesday, April 23:
Tammy Couture, 55, Pablo, was sentenced to the Department of Corrections for nine years, none suspended, after her 2007 suspended sentence of driving under the influence of alcohol or drugs as a persistent felony offender was revoked.
Couture was also sentenced to DOC for 12 years, none suspended, for driving under the influence of drugs or alcohol, fourth or subsequent offense. Couture had five DUI convictions when she was arrested again November 2013 for the most recent charge of driving under the influence of drugs or alcohol. The court also imposed a parole restriction of four years. The two sentences are to run concurrently, and Couture was credited for 150 days already served. She will be screened and considered for appropriate treatment.
Boe Miller, 36, Elmo, pleaded not guilty to both theft and criminal endangerment, both felonies. An omnibus hearing is set for June 4 and a jury trial July 14.
According to court documents, charges stem from March 14 when a security guard at Salish Kootenai College reported that someone hitched a construction trailer to their truck and was stealing it from the campus. The security guard followed the vehicle until Tribal Police took up the pursuit. The truck, driven by Boe Miller, would not stop and increased its speed along Light Road. A Lake County Sheriff’s deputy stopped his vehicle in the northbound lane, attempting to stop the northbound truck, but Miller did not slow down and forced the deputy into the ditch. Miller continued onto Back Road and into Polson, driving through town at speeds up to 60 mph, forcing additional cars off the road to avoid being hit. Miller then turned onto Tenth Avenue and jumped out of the truck while it was still moving. Officers chased Miller down and subdued him after tasing him twice. In an interview at the sheriff’s office, Miller told the deputy someone offered to pay him to steal the trailer, and he agreed because he needed money for methamphetamine. The trailer and its contents are valued at more than $1,500.
Gordon Larry Ahenakew, Jr., 27, Pablo, pleaded not guilty to burglary, a felony. An omnibus hearing is set for June 4 and a jury trial for July 28.
According to court documents, charges stem from a March 27 incident where a woman reported that a man had thrown a concrete block through her bedroom window. A Pendleton coat, a comforter and traditional dance regalia were missing. She said she called Dempsey’s Pawn in Polson and they confirmed that the items were pawned there. The woman’s daughter saw Ahenakew in a vehicle in the driveway and told him that he was not supposed to be at the house, and she called the police. That’s when Ahenakew allegedly broke the window and stole the items. A third woman drove Ahenakew to the house so he could “pick up some items,” and then drove Ahenakew to Dempsey’s to pawn the items.
Justin Teigen, 33, St. Ignatius, admitted violating conditions of parole and probation had his suspended sentences revoked. Teigen was sentenced to DOC for six years for criminal endangerment, a felony, and six years for tampering with witnesses, a felony. The sentences will run concurrently.
According to court documents, charges stem from a 2007 incident where Teigen and two other women, after drinking all day, drove to Mission and crashed into a tree. The two women suffered severe head trauma plus other injuries, yet Teigen did not call for help because he was on probation. Instead, he asked someone to move the car and then covered the damaged front end up with a mattress.
Delicia Morigeau, 37, Arlee, admitted violating conditions of probation and parole and had her suspended sentence revoked. She was sentenced to DOC for 10 years with five suspended for assault with a weapon, a felony; and five years, none suspended, for criminal possession of dangerous drugs, a felony.
According to court documents, charges stem from a September 2012 incident where Morigeau was arguing with a male over money. When she tried to leave in a vehicle, he tried to stop her by standing in front of the vehicle. Morigeau drove toward him with the vehicle, and he jumped to avoid going under the car and landed on the hood and windshield. Methamphetamine and other drugs were found in Morigeau’s car.
