Judge James A. Manley dealt with the following cases Wednesday, June 18:
Chance Herreid, 17, Ronan, received two three-year deferred sentences that will run conscutively for felony charges of criminal endangerment and possession of dangerous drugs.
Herreid was in Lake County Jail on Monday awaiting transport to bootcamp at the Montana Department of Corrections. The bootcamp is a condition of deferred sentence.
According to court documents, Polson Police responded on April 29 to Sixth Avenue West and Third Street West for a report of shots possibly fired from vehicles racing around town.
A vehicle matching the description given by the reporting party was located. The adult driver of the vehicle told police officers that Herreid had shot twice at another minor before the gun was disposed of.
Located in a search of the vehicle were two open knives, a set of scales, a jar of marijuana and small plastic bags. Some marijuana was also wrapped separately, apparently for distribution.
The vehicle was impounded and the suspects detained, but officers could not find the alleged gun.
An interview with witnesses confirmed Herreid shot twice at the 14-year-old minor. Witnesses said Facebook threats had occurred between the two recently. The 14-year-old’s bicycle tires had also been recently slit.
One of the witnesses said the shots fired sounded like those of a .22 caliber weapon.
Herreid would not talk with officers while detained. Once in detention, he kicked and spat on the walls of the holding cell.
On April 30 a gardener was pulling weeds at 209 Island Drive when he found a .22 pistol lying in the grass. The man called the police, who found the untouched gun with the chamber open and hammer still cocked. Three spent and three live casings were found with the weapon.
Herreid turns 18 years old on June 26.
Clark Alan Dibble, 43, Ronan, pleaded not guilty to driving under the influence of alcohol or drugs, fourth or subsequent offense, a felony. Dibble was released with SCRAM. An omnibus hearing is set for August 13 and a jury trial is set to begin Sept. 29.
According to court documents, charges stem from a May 18 incident when law enforcement got a call around 8 p.m. that a tan passenger car was swerving all over Highway 93. Dibble pulled into Town Pump in Ronan. Two witnesses told the deputy who responded that the driver was “hammered.”
When the deputy approached the car, Dibble had his head down behind the wheel and almost fell out when the Deputy opened the door. The deputy noticed two Mike’s Hard Lemonade cans in the vehicle. When asked to exit the vehicle, Dibble was unsteady on his feet and his eyes were red and glossy. He refused to perform sobriety tests and refused a breath sample. A blood draw was ordered at a local hospital and sent to the crime lab for analysis. Dibble’s driving record showed three prior DUIs.
Ricky Lawrence Baptiste admitted violating conditions of probation and had his suspended sentence revoked. He was sentenced to the Department of Corrections for five years and is to be considered for Connections Corrections. In July 2006, Baptiste pleaded not guilty to burglary, a felony, and theft, a misdemeanor. He later plea-bargained and his case was deferred.
Judge Deborah Kim Christopher dealt with the following cases Thursday, June 19:
Travis Thingelstad pleaded not guilty to stalking, a felony.
An omnibus hearing is set for July 10 and a jury trial is set to begin Monday, Sept. 8.
According to court documents, between April 11 and June 1, Thingelstad allegedly purposely and knowingly contacted a female victim who had a no contact order for Thingelstad. Thingelstad is accused of harrassing and intimidating the victim by sending more than 400 degrading, threatening and derogatory text messages.
In an interview, Thingelstad admitted sending the messages.
According to court documents, the victim feared for her life and is scared of what he might do to her if alone. Thingelstad posted a $50,000 bond for bail.
