City settles lawsuit for $8K

POLSON — The city of Polson and its engineer have settled a lawsuit brought against them by Sandry Construction Co. of Bigfork.
City Manager Mark Shrives said he signed the papers two weeks ago.
The city will pay $8,000 in the settlement and did not admit any wrongdoing, he said, adding that the city commission approved the settlement Nov. 20 last year.
Shari Johnson, the city’s engineer, declined to comment.
Sandry had asked for $32,358 in the suit, which was filed Nov. 19, 2016, for breach of contract.
Sandry was the successful bidder for some additional work done on the Polson sewer and water replacement project.
Sandry claimed that it encountered underground utilities, including storm drain crossings, that were not depicted in plans provided by the city engineer. Sandry said the plans were inadequate because they failed to identify a number of underground utilities and infrastructure.
The city and Sandry agreed that Sandry would be compensated for work done to address obstructions, according to the lawsuit.
Sandry said it submitted 15 additional documents evidencing additional labor and materials, and that the city agreed to pay only a portion of the additional expenses.
