Man sentenced for assault

Judge James Manley sentenced a Polson man in District Court at Polson on Oct. 28 to the Montana State Prison for 10 years with five years suspended on one count of assault with a weapon and another 10 years with all that time suspended on one count of tampering with witnesses or informant.
Alan Lewis Kibler, 35, who was deemed a persistent felony offender, was sentenced in accordance to a plea agreement reached on Sept. 9, that dismissed five other felonies, including two counts of partner or family member assault, two counts of tampering with witnesses and informants, and kidnapping.
According to court records, on May 26, a social worker with Child Protective Services reported to the Lake County Sheriff’s Office that Kibler may have assaulted a woman who was not identified to the public.
The social worker accompanied Polson police to the victim’s home. The front door had been damaged and appeared that a tool was used to pry it open. The victim’s right eye was black from what appeared to be an old injury. She also had scratches and other marks on her face. She said Kibler caused the injuries. She also said Kibler caused the damage to the door the night before.
The victim agreed to prohibit Kibler from seeing her. The officer and social worker left the home after providing the victim with domestic violence information. A short time later, the victim called 911 to report that she had told Kibler he was no longer welcome and he threatened to come over and “jack her up.”
She provided a statement about another assault that occurred May 20 when Kibler threatened her with a knife and said he would kill her and himself before forcing her and her three-year-old daughter to get in the car and ride to Buffalo Bridge. The victim said that while Kibler was driving he stated that he would kill her and throw her into the river. During the investigation, the victim was observed as having a circular scab wound she said was caused by Kibler burning her with a lit cigarette.
Kibler was arrested and initially charged with two counts of partner or family member assault, assault with a weapon and kidnapping. Prosecutor Molly Owen, with the Lake County Attorney’s Office, later tacked on three counts of tampering with witnesses and informants after Kibler made 147 phone calls from the Lake County jail to the victim while knowing he was to have no contact with her.
Manley ran the sentences consecutive to each other for a total of 20 years. The sentence will run consecutive to the probation Kibler was already serving on drug possession charges. Manley gave Kibler credit for 154 days of jail time already served.
