Lake County District Court news for Sept. 23, 2010

Judge Deborah Kim Christopher heard the following cases Thursday, Sept. 9:

Tiffany Faye Edwards, 23, of Ronan, pleaded guilty to deceptive practices, a felony, and forgery, a misdemeanor. The court accepted the plea agreement and found Edwards guilty.

According to court records, the felony charges stem from an incident where Edwards allegedly used a Cenex credit card, without the owner’s permission, to sell gasoline to others at a discounted price. The owner was her father of Edward’s boyfriend. The credit card statements reflected more than $3,000 in unauthorized fuel purchases.

According to court records, the misdemeanor charge stems from a time period of June through November 2009, where a total of 30 checks had been written without the owner’s permission on two different accounts. The owner was mother of Edward’s boyfriend.

Sentencing for both cases is set for Thursday, Oct. 21 at 9 a.m.

Kazz Stiger, 20, Ferndale, pleaded not guilty to charges of two counts of burglary, both felonies; criminal possession of dangerous drugs, a felony, and theft, a misdemeanor.

According to court records, the charges stem from an incident where Stiger allegedly broke into a home in Swan Lake, possibly twice, and stole a container of coins with an approximate value of $100 and a large amount of oxycontin.

An omnibus hearing is set for Thursday, Oct. 7 at 9 a.m.

Nathen D. Russell, 20, Pablo, pleaded not guilty to criminal possession with intent to distribute, a felony; and criminal possession of dangerous drugs, a felony.

According to court records, charges stem from an August 17 incident where a Montana Highway Patrol officer observed what appeared to be a drug transaction at Pier 93 gas station in Polson. After asking permission to search the vehicle, the trooper found several individually packaged bags of marijuana labeled by variety and price, plus several hydrocodone tablets. Russell admitted the marijuana was his, that it was intended for sale, and the tablets were also his and he did not have a prescription for them.

Omnibus hearing is set for Thursday, Oct. 21 at 9 a.m.

Cecilia Basilio, 32, Polson, pleaded not guilty to the charges of obstruction of justice, a felony. 

According to court records, charges stem from an August incident where police came to Basilio’s residence in Polson looking for Nathan Fisher, who had a warrant for a felony offense. Basilio denied Fisher was there but officers found him hiding in a closet.

An omnibus hearing is set for Thursday, Oct. 7 at 9 a.m.

Bradley Stevens, 39, St. Ignatius, was sentenced to Montana State Prison for eight years, with all suspended, for criminal production or manufacture of dangerous drugs, a felony. The sentence will run concurrent with a 5-year sentencing to the Department of Corrections for felony driving under the influence of alcohol or drugs, and another sentencing of 10 years in Montana State Prison for criminal endangerment, a felony. According to court records, charges stem from a January incident near Polson when a Sheriff’s deputy pulled Stevens over for erratic driving. Stevens fled on foot but was caught and brought to the Lake County Detention Center where Stevens provided a breath sample, which registered .114.

According to court records, Stevens has at least three prior convictions for driving under the influence of alcohol or drugs.

Al Bert Lee Buck, 36, Ronan, was sentenced to Montana State Prison for five years for bail jumping. The sentence will run concurrent with a previous 15-year sentence for aggravated assault (with 12 years suspended) imposed from a Dec. 8, 2007 incident in Ronan in which Buck got into a fight at a residence, according to court records.

Justin Keeble, 28, St. Ignatius, was sentenced to Lake County Jail for six months — all suspended but 45 days credit for time served — for partner or family member assault, a misdemeanor. For the offense of criminal endangerment, a felony, the court deferred the imposition of a sentence for two years provided Keeble successfully completes a batterer’s intervention program and chemical dependency evaluation.
 
Kevin Horsely, 48, Arlee, pleaded not guilty to charges of failing to register as a sexual offender, a felony. According to court records, Horsely was brought into the Lake County Detention Center in late August for traffic violations and it was discovered that he had not yet registered, although the court had ordered him to register in November 2009. An omnibus hearing is set for Thursday, Oct. 21 at 9 a.m.
 
Ronald Joe Martin, 47, of St. Ignatius changed his plea to guilty of the charge of driving under the influence of alcohol or drugs, a misdemeanor, as part of a plea agreement. The court accepted the plea agreement and found Martin guilty. He was sentenced to six months in Lake County Jail, all suspended except 10 days with credit for six days already served. 
 
Judge C.B. McNeil heard the following cases Wednesday, Sept. 15:
Jessie McDonald, 29, Arlee, was sentenced to the Montana Women’s Prison for three years, with credit for time in custody. This sentence will run concurrent with one imposed in Missoula County, and all original conditions are re-imposed.
 
McDonald’s suspended sentence for Fraudulently Obtaining Dangerous Drugs, a felony, was revoked Sept. 1 because McDonald failed to comply with court terms and conditions and rules of probation. According to court records, charges stem from an August 2003 incident where McDonald was found guilty of writing a fraudulent prescription for Lortab, a scheduled drug.
