Judge James A. Manley dealt with the following cases Wednesday, Dec. 2:
Craig Allen McCrea, 30, Ronan, pleaded not guilty to two separate charges of criminal possession of dangerous drugs, both felonies. An omnibus hearing is set for Jan. 13, 2016 and a jury trial is set to start Feb. 15, 2016.
According to court documents, on April 13 the vehicle McCrea was driving was stopped because the taillights were not working. Tin foil and tubes with oxycodone residue were discovered in the vehicle.
The second count occurred on July 8 when McCrea was arrested on an outstanding warrant in a car on Leighton Road that appeared to be suspicious. Drug paraphernalia was in plain view in the vehicle, and a Lake County Sheriff’s Deputy found a syringe loaded with methamphetamine in the passenger seat where McCrea was seated. McCrea allegedly admitted the syringe was his and he was about to shoot up before he saw law enforcement. A bag of meth was found in McCrea’s hat brim.
Jordan Thomas Pluff, 22, Polson, pleaded not guilty to three counts of felony burglary, two counts of felony theft, and one count of criminal mischief, a misdemeanor. An omnibus hearing is set for Feb. 3, 2016 and a jury trial is set to start March 14, 2016.
According to court documents, Pluff was allegedly involved with several burglaries/thefts in the Polson area between Aug. 10 and Oct. 3.
Erik Michael Aguiluz, 29, pleaded not guilty to sexual intercourse without consent, a felony. An omnibus hearing is set for March 30, 2016 and a jury trial is set to start May 2, 2016.
According to court documents, in August 2013 Aguiluz drove a female to Mission Dam. She stated she awoke with a black eye and found him on top of her, and she had pains in her pelvic area. Aquiluz said he was at the dam with her, but he never touched her, claiming she walked away from the vehicle and had not come back, so he left. Aguiluz voluntarily gave a DNA sample. The sample showed Aguiluz’s DNA on her left breast.
Tyler Frederick Erickson, 21, in a change of plea admitted committing an amended offense of felony criminal endangerment. Per the plea agreement, the court dismissed three other misdemeanor counts. He was sentenced to the Department of Corrections for five years with all suspended, except for time served on this case.
According to court documents, Erickson, while in Lake County Jail, was involved in a June 3 assault on an inmate.
Karisa Knievel Dooley, 43, Bigfork, had her suspended sentence for felony theft revoked, and she was sentenced to the Department of Corrections for five years.
Judge Deborah Kim Christopher dealt with the following cases Thursday, Dec. 3:
John Paul Montoya, 58, Arlee, pleaded not guilty to driving under the influence of alcohol or drugs, fourth or subsequent offense, and driving while license is suspended or revoked, a misdemeanor. An omnibus hearing is set for Jan. 28, 2016 and a jury trial is set to start April 11, 2016.
According to court documents, on Oct. 3 Montoya was stopped on Highway 93 near St. Ignatius because he had a non-working headlight. He appeared intoxicated but refused to provide a breath sample. A warrant was granted for the defendant’s blood and sent to the crime lab. His driving history showed that his driver’s license was suspended a the time of the incident. Montoya has seven prior DUI convictions in Wyoming and Utah, dating back to 1997, according to court documents.
Kristen Ashley Twoteeth, 28, Ronan, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for Jan. 28, 2016 and a jury trial is set to start April 11, 2016.
According to court documents, on Oct. 7 Twoteeth was detained for allegedly shoplifting at a Polson store. She refused to identify herself to an officer. She was arrested and a tribal ID was found in her pocket along with a bag of marijuana and a pill containing butalbital.
Lucy Marie Christie, 42, Ronan, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for Jan. 28, 2016 and a jury trial is set to start April 11, 2016.
According to court documents, on Oct. 16 Christie was stopped for driving 45 mph in a 25 mph zone on Skyline Drive in Polson. She consented to have her vehicle searched and the Montana Highway Patrol trooper found several prescription bottles in her purse. While one had her name on the label, the others appeared to be altered. One of the bottles contained hydrocodone, and Christie said the bottles are hers but she does not have a valid prescription for the pills.
Jacob Anthony Badhawk, 25, Polson, pleaded not guilty to aggravated assault, a felony. An omnibus hearing is set for Jan. 28, 2016 and a jury trial is set to start April 11, 2016.
According to court documents, on Sept. 13 Badhawk allegedly came home drunk and got in an argument with a woman. He allegedly grabbed her arms, pushed her down and held her. She punched him in the face to try to escape and he started to choke her, according to the victim. She finally fought him off and he fled.
Derrick Cecil Pluff, 28, Polson, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for Dec. 12 and a jury trial is set to start Jan. 5, 2016.
According to court documents, on July 16 a business in Polson called dispatch to have Pluff removed. In the past Pluff had been removed and asked not to return. A pill container with another man’s name was found in Pluff’s pocket. One of the pills contained amphetamine, a dangerous drug.
Richard Dean McBroom, 55, Polson, pleaded not guilty to felony burglary. An omnibus hearing is set for Jan. 28, 2016 and a jury trial is set to start April 11, 2016.
According to court documents, on Nov. 13 a local restaurant owner called to report that someone had broken in during the night, poured gasoline in the office and turned on all the burners. She suspected McBroom, who had worked for her as a handyman, because he wanted to be involved in a romantic relationship with her and she did not. She showed the officer texts from McBroom that changed from telling her he loves her to cursing at her and calling her names because she wasn’t interested. He later admitted he had entered the restaurant, taken cash from the safe and placed a 5-gallon gas can on the desk in the office, although he didn’t remember turning on the burners in the kitchen.
Christopher Louis McCrea, 30, Ronan, pleaded not guilty to felony assault with a weapon. An omnibus hearing is set for Jan. 28, 2016 and a jury trial is set to start April 11, 2016.
According to court documents, on Nov. 7 McCrea allegedly hit another man in the neck with a beer bottle that broke and cut the man’s neck while McCrea was riding in the backseat of a truck driven by a female friend. The woman driver and the victim in the passenger seat have a child together, and when the two began to argue, McCrea said he hit the victim because he didn’t like what he was saying about his female friend. McCrea later admitted he made a bad decision and regretted it.
Richard Twoteeth, 19, Arlee, pleaded not guilty to aggravated assault and tampering with evidence, both felonies. An omnibus hearing is set for Jan. 28, 2016 and a jury trial is set to start April 11, 2016.
According to court documents, on Oct. 19 Twoteeth went to a male’s residence in Arlee, where two people heard Twoteeth say he was going to kill the male. The male woke up in his bed as Twoteeth was hitting him in the face with his fists, and using what Twoteeth calls his “ninja cowboy boots” to kick the victim in the face, causing the victim to have a broken eye socket. Twoteeth left the house and threw the boots away, then was arrested when he returned to the home.
Christine Diane Wingender, in a change of plea, admitted committing the offense of criminal possession of dangerous drugs with intent to distribute. Sentencing is set for Jan. 14, 2016.
David William Parnell, in a change of plea, admitted committing the offense of criminal possession of dangerous drugs, a felony. He was released until sentencing, which is set for Jan. 21, 2016.
