Judge James A. Manley dealt with the following cases Wednesday, Feb. 3: 

Daphne G. Mitchell, 41, Polson, was sentenced to the Department of Corrections for five years, none suspended, for criminal possession of dangerous drugs, a felony.

According to court documents, Mitchell was arrested Aug. 17, 2015, on an outstanding warrant. Law enforcement found a baggie of meth next to the passenger seat where she was seated in a vehicle.

Brandon W. Dunkerson, 30, pleaded not guilty to assault with a weapon, a felony; operation of noncommercial vehicle by person with alcohol concentration of .08 or more, second offense, a misdemeanor; and driving while license is suspended or revoked, a misdemeanor. An omnibus hearing is set for May 4 and a jury trial is set for June 20.

According to court documents, on July 26, 2014, Dunkerson allegedly tried to choke another male in Pablo and then pointed a loaded gun at him, telling the man that he was going to kill him. When law enforcement arrived, Dunkerson allegedly admitted that was driving his vehicle while intoxicated. Two of Dunkerson’s breath samples read .117 and .128 blood alcohol concentration, and he had been driving on a suspended license.

Delta Dawn Clark, 30, Pablo, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for March 30 and a jury trial is set to start May 2.

According to court documents, Clark was present during a probation search of a residence in Pablo. Clark allegedly grabbed a bag and tried to leave. She was stopped and the bag searched. Inside were a pipe and a glass container containing methamphetamine.

James Lee Hoskinson, 23, Polson, per a plea agreement admitted committing the offense of criminal possession of dangerous drugs, a felony. The court found him guilty, and set sentencing for March 23. Hoskinson was released on his own recognizance to get a chemical dependency evaluation.

According to court documents, on Nov. 30, 2015, methamphetamine and paraphernalia were found in Hoskinson’s backpack.

Kyler Martin Runkel, 21, Ronan, pleaded not guilty to sexual assault, a felony; and unlawful transactions with children, a misdemeanor. An omnibus hearing is set for May 4 and a jury trial is set for June 20.

According to court documents, on Jan. 27, then 20-year-old Runkel allegedly subjected a 13-year-old female to sexual contact in a Ronan park after giving her four shots of vodka. The victim suffered bruising from the struggle.

Chelsea Loretta Garfield, 31, Coram. According to court documents, on Dec. 23, 2014, Garfield was arrested on a warrant and a morphine pill was found in her bra.

Angela Rose Gopher, 19, Missoula, per a plea agreement admitted committing the offense of criminal possession of dangerous drugs, a felony. The court found her guilty and set sentencing for March 23.

According to court documents, on Jan. 2, 2015, an officer was called to a Polson motel to remove some guests from a room who had paid for one night, five nights prior. Gopher was in the room, and was a minor at the time. She was arrested for being a minor in possession of alcohol and sent to tribal jail, where a detention officer located a baggie with meth residue inside.

Robert Clark, 33, Ronan, per a plea agreement admitted committing the offense of criminal possession of dangerous drugs, a felony. The court found him guilty and set sentencing for March 23.

According to court documents, on June 20, 2013, drugs were discovered in his residence during a search conducted by the Mission Mountain Drug Task Force.

Craig Allen McCrea, 30, Ronan, per a plea agreement admitted committing the offenses of burglary, a felony; and criminal possession of dangerous drugs, a felony. The court found him guilty. A third charge will be dismissed at sentencing on March 30.

According to court documents, burglary charges stem from a Jan. 20, 2015 incident where McCrea stole a television set from a Pablo residence. Drug charges stem from a July 8, 2015 incident where McCrea was in a car reported as suspicious. A syringe with meth and blood was found in the car, and McCrea admitted he was about to inject it before the police showed up. A baggie of meth was also found in McCrea’s hat brim. 

Judge Deborah Kim Christopher dealt with the following cases Thursday, Feb. 4:

Kortny Gene Duback, 31, Polson, had his sentence for felony criminal possession of dangerous drugs deferred for three years under the condition that he attend and successfully complete Montana Treasure State Boot Camp.

According to court documents, on March 10, 2015, a drug scale with methamphetamine residue was found in Duback’s waistband when he was booked in Tribal Jail on outstanding warrants.

Christopher Jermaine Marks, 35, Ronan, was sentenced to DOC for three years, all suspended but 26 days already served, for criminal possession of dangerous drugs, a felony. 

According to court documents, on July 25, 2015, Marks was arrested on outstanding warrants. In his pants pocket were nine syringes, a kit for intravenous drug use, and a glass pipe with meth residue. Marks told the deputy, “I don’t use it, I just hold it for people and hook them up.”

Josie Lynn Bear, 29, Charlo, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for April 28, a status conference for May 26, and a jury trial for July 11.

According to court documents, on May 15, 2015, was a passenger in a car that was searched. Her purse allegedly contained two baggies with meth residue, meth paraphernalia, a marijuana pipe, and a plastic container with marijuana residue.

Lacey Marcelline Burke, 38, Ronan, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for April 28, a status conference for May 26, and a jury trial for July 11.

According to court documents, on Aug. 22, 2014, Burke was arrested on an outstanding warrant and a syringe containing meth was found on her person.

Marcyanna Rose Dimond, 38, Polson, pleaded not guilty to burglary and theft, both felonies. Judge Christopher recused herself from the case. A trial setting order will be set by whichever judge ends up with the case.

David Jason Erickson, 41, Bigfork, pleaded not guilty to violation of order of protection, a misdemeanor; a second count of violation of order of protection, a misdemeanor, with the potential to become a felony if convicted of count one; stalking, a felony; and partner or family member assault, a misdemeanor. An omnibus hearing is set for March 31, a status conference for May 5, and a jury trial for June 27.

According to court documents, in November 2014 Erickson allegedly poured a hot cup of coffee over a female’s head because she “didn’t make it strong enough.” During the winter of 2014-15, Erickson allegedly shoved the woman’s head in the snow until she feared she would pass out. In June 2015, Erickson allegedly came to her residence without permission and for three or four hours repeatedly knocked her to the floor, pulling her hair out, screaming at her and telling her he loved her. A permanent order of protection was granted Sept. 18, 2015, but on Nov. 8, 2015, Erickson sat two rows behind her in church and told church officials that the order didn’t apply in church. There is no such provision excluding church services in the order of protection.

Marko Lee Trombley, 27, Polson, pleaded not guilty to partner or family member assault, third or subsequent offense, a felony; sexual intercourse without consent, a felony; and kidnapping, a felony. An omnibus hearing is set for March 31, a status conference for May 5, and a jury trial for June 27.

According to court documents, on Dec. 13, 2015, Trombley allegedly accused a female of cheating on him, hitting her in the face and head multiple times and kicking her in the chest. He allegedly sexually assaulted her and then held her against her will, using physical force to prevent her from leaving. Trombley has three prior convictions for partner of family member assault.

Billie Jo Montelongo, 39, Polson, pleaded not guilty to criminal possession of dangerous drugs, a felony; and theft, a felony. An omnibus hearing is set for March 31, a status conference for May 5, and a jury trial for June 27.

According to court documents, on Dec. 9 Montelongo allegedly stole a coat while staying at a lodge. In the coat pocket were keys to a vehicle, which was driven and abandoned miles away by a male staying with Montelongo. Property belonging to the couple was found in the Jeep. Methamphetamine residue and a meth pipe were found in the room where Montelongo and the male were staying.

Thurston Leslie James, 48, Polson, pleaded not guilty to criminal possession of dangerous drugs, a felony. An omnibus hearing is set for April 28, a status conference for May 26, and a jury trial for July 11.

According to court documents, on Jan. 6 James paid for gasoline with two $10 bills. The clerk noticed a bag of methamphetamine stuck between the two bills and notified law enforcement. James denied knowledge of the meth, but admitted using drugs in the previous month and was arrested on unrelated warrants for felony possession of dangerous drugs.

Angelina Dempsey, 40, Polson, in a change of plea admitted committing the offense of criminal possession of dangerous drugs, a felony. The court found her guilty and set sentencing for April 7.

According to court documents, on April 14, 2012, Dempsey was arrested on outstanding warrants. A syringe containing meth was found on her person, along with two Clonazepam pills, a spoon and cotton balls.
